We would need you to withdraw since the USACE has confirmed that they will not be issuing an after -the -fact permit
and our permits coincide with theirs. We can move forward with this as a noncompliance issue. Please keep me
updated on the restoration and invite me to any site visits for this issue. Any photos that can be provided to keep me

Would you require a PCN submittal at a later date if we withdraw, or can we handle this as a non-compliance issue with
the DEQ as well? The goal is to completely restore the areas impacted without authorization. However, the planting
must occur in fall to ensure the survival of the trees.

staff need clarification from the USACE on the viability of an after -the -fact authorization for these impacts.
