Dear Ms. White:
On December 8, 2011 Ms. Barbara Sifford with the Division of Water Quality,
Mooresville Regional Office performed a Compliance Evaluation Inspection of the Single
Family Residence discharge. The inspection and review of the files determined the following
facts:
Permit •
The permit has not been renewed since 2002. No annual fees have been paid since 2005.
A renewal application is due in January 2012 to renew this permit for continued treatment-
and disposal of the sewage from this residence.
Operation and Maintenance,
.The owner has failed to operate and maintain the facility as designed by properly
disinfecting the wastewater prior to discharging to surface waters of the State of North
Carolina and maintaining the facility as designed with an outfall pipe to a tributary of
Crowders Creek.

The above noted violations are subject to a civil penalty assessment of up to $25,000.00
per day for each violation. Penalties may also be assessed for any damage to the surface waters
of the State that may result.
It is requested that you respond in writing to this Notice of Violation within 30 days of
receipt. Your response should be sent to the Mooresville Regional Office at the address on the
bottom of the letterhead. Your response should address the following items:
(1) Please provide a plan to restore the treatment units as originally designed.
(2) Renewal of your permit.
(3) Payment of annual fees.
(4) Analytical documentation for compliance monitoring.

The residence has not connected to municipal sewer therefore the Single Family Discharge Permit is still
the only option of treatment for this location. The pipe should be located and another section added to get
the discharge to the creek. Chlorine tablets should be used to disinfect the discharge. Annual analytical
should be conducted to provide compliance documentation.

Comment: Discharge pipe was covered over with rocks, chlorinator box was not •
visible in the yard. Owner said that DOT covered the pipe. Residence has not
connected to City sewer (it is not available) so therefore the septic tank and sand bed
are still in the yard. Need to locate the line to the creek and reinstall the chlorinator box
to disinfect the discharge.

Comment: Permit should be renewed and annual fees paid, NCDENR will investigate
with DOT to determine if rocks broke off pipe or if it was already broken off by erosion of
the stream bank. Fox Wood community well is just across the street and downstream
of the discharge.
