Dear Ms. Smith-Peri:
Attached is a revised sheet A.(1) EFFLUENT LIMITATIONS AND MONITORING
REQUIREMENTS page for NPDES permit NCO077143 which was recently issued to you as a
modification. The sampling. requirement for dissolved oxygen was listed as a composite sample, it
should have been a grab sample. In addition, as you requested, we are granting an 18 month compliance
schedule for the composite sample requirements. Until April 1, 2008, you can take grab samples.
Composite sampling will be required starting on April 1, 2008. Please remove the old page A. (1) from
your permit and replace it with the attached,page A. (1).
Please take notice that this permit is not transferable. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or
Local governmental permits which may be required.

A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is
authorized to discharge filter backwash from outfall 001. Such discharges shall be limited and monitored by
the Permittee as specified below:

1. The pH shall not be less than 6.8 standard units nor greater than 8.5 standard units.
2. Acute 24-hour Pass/ Fail (Fathead Minnow OR Mysid Shrimp OR Silverside Minnow, Permittee's choice)
at 90%; January, April, July and October; refer to Special Condition A (2).
3. The requirement for composite samples will begin on April 1, 2008. Grab samples shall suffice until
that date.
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

-Request for Sample Waiver/Extersion
Dear Ms. Bryant:
In the process of requesting a permit amendment to include future iron removal at our water treatment
plant, which should be completed in approximately 18 months, our monitoring requirements were greatly
amended. Thinking that it was because of the future changes to our plant, I spoke with James McKay on
August 17, 2006. At that time, we were told that the original permit would remain in place until iron
removal was added. However, on September 18, 2006, I received a very nice email from Mr. McKay who
explained that he had misinterpreted the permit and it actually is effective this month.
I was quite concerned about receiving a violation because of the time constraint to make arrangements to
take the samples listed, some of which are now composite samples. I still am unclear as to why we are
having to sample for the items listed as compared to other similar water treatment systems. Therefore, I do
plan to follow-up with Mr. McKay again regarding that since I can not seem to find anything on the
internet that links the samples to our current treatment. In the meantime, he suggested in a subsequent email.
that I contact you to request a compliance schedule to give us time to authorize, purchase, and install a
composite sampler system. I have .contacted a few companies about purchasing a refrigerated, all-weather
composite sampler, which will cost in excess of $5,000. Once .the proper equipment is selected and
ordered, we can expect a delivery within 3 weeks. As such, -we are requesting a time extension to take the
samples listed. Our board will meet on October 10`h. -I plan to have the purchase authorized at that time,
but.I can request an emergency meeting if needed.
In good faith, we attempted to clarify the permit when we received it. Since September 30'h is quickly

requirement could be extended a few months, in as much as our treatment and effluent has not changed.
