HomeMy WebLinkAboutWQ0019649_Application (FTSE)_20240529State of North Carolina nWR Department of Environmental Quality Division of Water Resources FAST TRACK SEWER SYSTEM EXTENSION APPLICATION Division of Water Resources INSTRUCTIONS FOR FORM: FTA 06-21 & SUPPORTING DOCUMENTATION This application is for sewer extensions involving gravity sewers, pump stations and force mains, or any combination that has been certified by a professional engineer and the applicant that the project meets the requirements of 15A NCAC 02T and the Division's Minimum Design Criteria (Gravi1y Sewer & Pump Stations/Force Mains) and that plans, specifications and supporting documents have been prepared in accordance with 15A NCAC 02T, 15A NCAC 02T .0300, Division policies, and good engineering practices. While no upfront engineering design documents are required for submittal, in accordance with 15A NCAC 02T .0305(b), design documents must be prepared prior to submittal of a fast track permit application to the Division. This would include plans, design calculations, and project specifications referenced in 15A NCAC 02T .0305 and the applicable minimum design criteria. These documents shall be immediately available upon request by the Division. Projects that are deemed permitted (do not require a permit from the Division) are explained in 15A NCAC 02T.0303. Projects not eligible for review via the fast track process (must be submitted for full technical review): ➢ Projects that do not meet any part of the minimum design criteria (MDC) documents; ➢ Projects that involve more than one variance from the requirements of 15A NCAC 02T; ➢ Pressure sewer systems utilizing simplex septic tank -effluent pumps (STEPs) or simplex grinder pumps; ➢ Simplex STEP or simplex grinder pumps connecting to pressurized systems (e.g. force mains); ➢ Vacuum sewer systems. General — When submitting an application, please use the following instructions as a checklist in order to ensure all required items are submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of requested additional information. Failure to submit all required items will necessitate additional processing and review time, and may result in return of the application. Unless otherwise noted, the Applicant shall submit one original and one copy of the application and supporting documentation. A. One Original and One Copy (second copy may be digital) of Application and Supporting Documents ® Required unless otherwise noted. Signatures on original must be "wet ink" or secure digital signatures. Please do not submit engineering design plans with the application unless specifically requested. B. Cover Letter/Narrative Description (Required for All Application Packages): ® List all items included in the application package, as well as a brief description of the requested permitting action. ➢ Be specific as to the system type, number of homes served, flow allocation required, etc. ➢ Include the permit number/status of any other required sewer permits (downstream/upstream) ➢ If necessary for clarity, include attachments to the application form. C. Application Fee (All New and Modification Application Packages): , ® Submit a check or money order in the amount of $480.00, dated no more than 90 days prior to application submittal. ➢ Payable to North Carolina Department of Environmental Quality (NCDEQ) D. Fast Track Application (Required for All Application Packages, Form FTA 05-21): ® Submit the completed and appropriately executed application. ➢ If necessary for clarity or due to space restrictions, attachments to the application may be made. ❑ If the Applicant Type in Item I.2 is a corporation or company, provide documentation it is registered for business with the North Carolina Secretary of State. ❑ If the Applicant Type in Item I.2 is a partnership or d/b/a, enclose a copy of the certificate filed with the Register of Deeds in the county of business. ® The Project Name in Item II.1 shall be consistent with the project name on the flow acceptance letters, agreements, etc. ® The Professional Engineer's Certification on Page 5 of the application shall be signed, sealed and dated by a North Carolina licensed Professional Engineer ® The Applicant's Certification on Page 5 of the application shall be signed in accordance with 15A NCAC 02T .0106(b). Per ISA NCAC 02T .0106(c), an alternate person may be designated as the signing official if a delegation letter is provided from a person who meets the criteria in 15A NCAC 02T .0106(b). Flow Tracking/Acceptance Form (Form: FTSE 04-16) (If Applicable): ® Submit the completed and executed FTSE form from the owners of the downstream sewers and treatment facility. ➢ Multiple forms maybe required where the downstream sewer owner and wastewater treatment facility are different. ➢ The flow acceptance indicated in form FTSE must not expire prior to permit issuance and must be dated less than one year prior to the application date. ➢ Submittal of this application and form FTSE indicates that owner has adequate capacity and will not violate G.S. 143-215.67(a). ➢ Intergovernmental agreements or other contracts will not be accepted in lieu of a project -specific FTSE. F. Site Maps (All Application Packages): ® Submit an 8.5-inch x 11-inch color copy of a USGS Topographic Map of sufficient scale to identify the entire project area, including the closest surface waters. ➢ General location of the project components (gravity sewer, pump stations, & force main) ➢ Downstream connection points and pen -nit number (if known) for the receiving sewer ® Include an aerial location map showing general project area (such as street names or latitude/longitude) so that Division staff can easily locate it in the field. G. Existing Permit (Application Packages for Modifications to an Existing Permit): ® Submit a copy of the most recently issued existing permit. ® Include a descriptive and clear narrative identifying the previously permitted items to remain in the permit, items to be added, and/or items to be modified (the application form itself should include only include items to be added/modified). The narrative should also include whether any previously permitted items have been certified. ® The narrative should clearly identify the requested permitting action and accurately describe the sewers to be listed in the final permit. H. Power Reliability Plan (Required if portable reliability option utilized for Pump Station): ❑ Per 15A NCAC 02T .0305(h)(1), submit documentation of power reliability for pumping stations. ➢ This alternative is only available for average daily flows less than 15,000 gallons per day ➢ It shall be demonstrated to the Division that the portable source is owned or contracted by the applicant and is compatible with the station. The Division will accept a letter signed by the applicant (see 15A NCAC 02T .0106(b)) or proposed contractor, stating that "the portable power generation unit or portable, independently -powered pumping units, associated appurtenances and personnel are available for distribution and operation of this pump station." ➢ If the portable power source or pump is dedicated to multiple pump stations, an evaluation of all the pump stations' storage capacities and the rotation schedule of the portable power source or pump, including travel timeframes, shall be provided in the case of a multiple station power outage. (Required at time of certification) I. Certificate of Public Convenience and Necessity (All Application Packages for Privately -Owned Public Utilities): ❑ Per 15A NCAC 02T .0115(a)(1) provide the Certificate of Public Convenience and Necessity from the North Carolina Utilities Commission demonstrating the Applicant is authorized to hold the utility franchise for the area to be served by the sewer extension, or ❑ Provide a letter from the North Carolina Utilities Commission's Water and Sewer Division Public Staff stating an application for a franchise has been received and that the service area is contiguous to an existing franchised area or that franchise approval is expected. J. They are: 1. Pine Level PS, which is now permit WQ0042434 2. West Johnston High School PS, which is getting a new permit number (not yet known), and 3. Four Oaks PS Thus, permit WQ0019649 is now ONLY for the Four Oaks PS described below. The Four Oaks Wastewater PS (WQ0019649) receives most of its flow from the Town of Four Oaks. The Four Oaks PS consists of an Influent PS, an Equalization (EQ) basin, and Effluent PS. The existing estimated capacity of each facility is as follows: • Influent PS - 500 gpm • EQ basin - 0.20 MG • Effluent PS - 320 gpm (current permitted capacity of the Four Oaks PS) Wastewater enters the site through existing gravity sewers. The existing Influent PS pumps influent wastewater into existing concrete channels, Parshall Flume and through an existing flow distribution box before entering the existing EQ Basin. From the existing EQ Basin, the existing Effluent PS conveys wastewater through one of two force mains as follows: 1. To the Benson WWTP (NC0020389) through an 8/12-inch force main, with direct discharge to the Benson WWTP. 2. To the Johnston County Wastewater Treatment Plant (NC0030716) through a 6-inch force main with discharge to a gravity sewer upstream of the Holts Lake PS and requires re - pumping through both the Holts Lake PS, and the Neuse River PS with treatment at the County's Central Johnston County Wastewater Treatment Plant in Smithfield. Influent PS a. PS consisting of two constant speed submersible pumps in a wet well. Firm capacity of 500 gpm at 24 feet of pressure. b. Sewage grinder in the wet well c. 95 linear feet of 8-inch PVC force main between wet well and EQ Basin d. Liquid chemical feed system for odor and corrosion control 2. EQ Basin a. 0.2 MG capacity b. Concrete lined 3. Effluent PS a. PS consisting of three variable speed submersible pumps within a wet well. Firm capacity of 780 gpm as follows: i. 360 gpm at 238 feet of operating pressure towards the Town of Benson WWTP ii. 420 gpm at 230 feet of operating pressure to Johnston County's collection system. b. Valve vault for check and isolation valves including electrically actuated valves to divert spare pump to serve as lag pump to either of the two force mains, as needed. 4. Electrical building a. Audible and visual alarm on building exterior. Both the influent and effluent PS alarms are relayed to the Electrical Building's audible alarm, visual alarm and remote alarm via SCADA. b. Exterior diesel generator with automatic transfer switch within the building c. Cellular -based SCADA telemetry system 5. Force Main to Johnston County a. Magnetic flow meter in a vault b. 7,030 linear feet of 8-inch DIP c. 180 linear feet of 12-inch DIP d. 37,390 linear feet of 8-inch PVC The proposed triplex Effluent PS will have a firm capacity of 1.12-mgd (780 gpm) as follows: 1. Ability to simultaneously pump wastewater in both directions to the Benson WWTP (360 gpm) and towards the Johnston County WWTP (420 gpm). 2. Three (3) wet -pit submersible pumps, with (2) two duty and (1) spare pump. All three pumps are identical; however, they will operate at slightly different flow -head conditions based upon which force main they are pumping through. a. Pump 3 dedicated to the 8-inch force main to Benson with a capacity of 360 gpm. This will continue to be the primary method of wastewater pumping. b. Pump 1 dedicated to the 6-inch force main to Johnston County with a capacity of 420 gpm. This pump will be the lag pump and convey wastewater to the Central Johnston County WWTP during high flow conditions or when the County needs to perform service to the force main to Benson's WWTP. c. Pump 2 will be the spare pump to either Pump 1 or 3, providing the required redundancy. Pump 2 will automatically be placed into service by the station's controls and electrically actuated valves when 1) either Pump 1 or 3 fails, or 2) routine alternation of pumps to distribute runtimes evenly between pumps. While the existing influent pumps are rated for 500 gpm, the County requests a permitted capacity of 780 gpm for the facility based upon the capacity of the proposed effluent pumps because: 1. Wastewater flow continues to increase as the population of the service area continues to increase. (Separate permits will be provided for any new development connections tributary to the Four Oaks Station.) 2. The County wants the ability to dewater the EQ basin more rapidly using existing infrastructure (e.g.: existing force mains, generator). 3. The County wants the ability to convey wastewater to two separate wastewater treatment plants maximizing regional treatment capacity. More specifically, once the County's 210 WWTP is operational, existing wastewater will be diverted to it which then reduces flow to the Central Johnston County WWTP, which the Four Oaks PS can then partially use. In follow-up, just a few comments and questions. 1. If folks at Johnston County are in agreement with this (as we are handling this through the fast track process, but it's a bit unusual with it's current configuration) — I think we should leave out the specifics on the internal piping configuration. I don't believe the Division does that with Authorization to Construct permits for wastewater treatment plants and I don't think we should do it with this fast track. Steve is ensuring it is in compliance with the minimum design criteria. I believe the intent of the fast track permit is to account for any additional linear footage up to the influent pump station and any additional footage with regard to the force main(s) from the effluent pump station. Let me know if y'all think differently. Some aspects of these improvements I may refer to generally or obliquely. I'll probably run some draft language by you folks just to make sure I've adequately covered everything (and we've included everything). OK, we removed references to new gravity sewer in Section VII because that's `internal piping'. I've had to pick this up and put it back down again several times. Could you correct Section G (and documentation submitted January 12th) to reflect the appropriate gpm throughout the document? Some things say 780 gpm, some things say 880 gpm (and also correct 5.a. on the narrative). The October version was 880 gpm, but the January version was corrected to 780 gpm. As with no. 2, 1 think it would be best to correct Part VII And Part VIII of the application to reflect the amount of gravity sewer line to be permitted prior to the influent pump station and the amount of force main to be included after the effluent pump station (which may already be captured correctly here). Section VII gravity sewer info was removed. Section Vill is correct and only reflects the proposed FM to be installed. and new Also review Part VI11.4. and confirm. I'm just trying to figure out how to best capture what is to be permitted and included in this stand alone document (and tryto make it a bit less confusing). A new application is attached with revised Section VIII. We show two design points, just to be clear on capacity to each direction: one for 420 gpm at 230 feet for the pumps to Johnston County, and 360 gpm at 238 feet for the pumps to Benson. I suggest discarding the prior FTA 06-21 form and prior Narratives and instead use the attached FTA and Narrative. 4. Since the latest version (5/1/18) of this permit did not include some aspects of what is currently in use at the Four Oaks pump station —we are going to include those with this current version (for example the EQ basin; I believe in our previous discussion Kim understood it was permitted some time ago under a different entity. I cannot locate that permit). I think with this version we just need to make sure we include what is currently in use and on site along with the improvements (which I believe you folks also wanted). The County agrees. The narrative includes everything existing and proposed within the fence and to both FM discharge points. 5. The latest permit also includes 150,000 gpd flow allocation (from a modification dated 5/25/05). I'll refer to it in a manner similar to how I handled the West Johnston HS FM permit we did recently. These improvements will be 0 GPD flow allocation and that will be reflected in this modification. *Also with the proposed improvements there is no guarantee that the Division of Water Resources will approve tributary flow unless/ until the demonstration of ability to accommodate such wastewater flow.* The County agrees. 6. If the Division approves the 880 gprn (780 gpm) capacity, of course should issues arise with allocations based on that, Johnston County will have to take measures to correct that situation (as I'm sure everyone is aware). The County agrees, and to clarify, the new firm capacity is 780 gpm. 7. Has the agreement with Benson been finalized? Can someone pass that along tome? Also who is the best contact for the Town of Benson (and if someone could include an email for that person). The County is still operating under the existing 1999 agreement, which is attached. One alarm system for both PSs. All signals will be routed to the proposed alarm system located at Electrical Building. 9. Holt Lake PS/FM permit was recently upgraded to 700 gpm. What is the status? The Holt Lake Station will be started up within 30 days. The final engineer's certification will be submitted shortly thereafter. And the Neuse River PS is in design phase? Neuse River PS is in the 100% design phase. Its firm capacity will be 1,400 gpm. A FastTrack application will be submitted in May 2024. Plan to advertise for bids in August 2024. As stated in no. 5 above, Johnston County will have to adequately demonstrate that these pump stations can accommodate future tributary flow. This one is at the top of my list. If anything here is confusing and/or we need to do a teams call- I will do my best to work with your schedules. Agreements Approved for Benson -Clayton -County Wastewater Transmission and Treatment Tim Broome, Public Utilities Director, requested the Board approve an interlocal agreement for purchase and transfer of wastewater capacity between the County, the Town of Benson and the Town of Clayton. Under the agreement, Clayton would purchase 150,000 gpd of wastewater treatment allocation from the County, and the County would purchase an equal capacity from the Town of Benson. A wastewater force main would need to be constructed from the County's pump station in Four Oaks to the Benson WWTP to transfer the wastewater. Under the proposed program, the County has qualified for a $500,000 Rural Center grant for assistance in the force main construction. On the basis of the original project budget, the Count}, would be required to appropriate supplemental funds in the amount of $225,000. Bids for the force main were received on April 28, 2005, and due to a higher construction cost than expected, the County contribution now required is $383,000. County Manager Rick Hester recommended the Board approve the agreement between the County and the Rural Center for the $500,000 grant, and also approve the interlocal agreement for purchase and transfer ofwastewater capacity between the County, the Town of Benson and the Town of Clayton. Further, he recommended the Board appropriate $260,000 from the general fund in the FY 05-06 budget for the project. It is anticipated the Town of Clayton will be loaning $123,000 to the project. Upon a motion by Commissioner DeVan Barbour, seconded by Commissioner Tony Braswell and carried by unanimous vote , the Board approved the following: 1) agreement between the County and the Rural Center for the $500,000 grant, and 2) interlocal agreement for purchase and transfer ofwastewater capacity between the County, the Town of Benson and the Town of Clayton, and 3) appropriation of $260,000 in FY 05-06 for the project. WITNESSETH WHEREAS the Town of Clayton has purchased treatment capacity in the Johnston County Central Wastewater Treatment Plant (WWTP) and has the need for an additional treatment capacity allocation; and WHEREAS Johnston County's expanded WWTP will be allocated at 80% of its capacity when it comes on line in May of 2005, and the County must initiate further expansion of its wastewater treatment capacity; and WHEREAS the Town of Benson's wastewater treatment facility currently has surplus treatment capacity and the Town intends to construct additional capacity, and that it will allow Johnston County to purchase 0.150 mgd if Johnston County wastewater transmission facilities are extended to the Town of Benson's wastewater treatment plant; and WHEREAS the Town of Benson will permit the County's initial temporary capacity purchase to become permanent and desires to sell additional permanent treatment allocations when its WWTP is expanded; and WHEREAS Johnston County has received a $500,000 North Carolina Rural Center Economic Incentive Grant to construct a Four Oaks to Benson wastewater force main interconnector that will allow Johnston County to transport wastewater to the Town of Benson's WWTP for treatment; and WHEREAS the Town of Benson has received a $425,000 North Carolina Rural Center Economic Incentive Grant to increase its WWTP capacity by 0.4 mgd to allow Johnston County to purchase a permanent treatment capacity allocation in the expanded facility. NOW, THEREFORE, in consideration of the mutual covenants and promises set forth herein, Johnston County, the Town of Benson and the Town of Clayton hereby agree as follow: May 9, 2005 Continued ARTICLE 1 TERMS OF AGREEMENT AND TERMINATION l . The Town of Clayton will purchase a permanent wastewater allocation of 0.150 mgd from Johnston County for a capacity fee of $900,000, and Johnston County will allocate a capacity of 0.150 mgd in its WWTP for use by the Town of Clayton. 2. Johnston County will design and construct the Four Oaks to Benson wastewater force main and complete necessary pumping improvements. The estimated cost of the project is $1,200,000. 3. The Town of Benson will design and construct a 0.4 mgd WWTP expansion. 4. The Town of Benson will allocate a capacity of 0.150 mgd in its WWTP for use by Johnston County. The commodity cost for treatment shall be equal to the bulk wastewater treatment fee Johnston County charges the Town of Clayton and its other bulk customers. The commodity cost is subject to upward adjustment annually. The current bulk commodity fee charged by the County is $2.15 per 1,000 gallons. 5. Johnston County will pay the Town of Benson a fee in the amount of $300,000 for the 150,000 gpd wastewater allocation. Johnston County will pay a fee of $125,000 as a deposit against a future wastewater capacity allocation. 6. The Town of Benson will sell additional capacity to Johnston County in the future. The Town agrees to sell at least 150,000 gpd. The unit value (cost per gpd) of the future wastewater allocation shall be negotiated between the Town of Benson and the County within limits of the then current actual capital costs for wastewater plant expansions by the respective parties. 7. Assignment. This Agreement shall insure to the benefit of and be binding upon the parties hereto and their respective heirs, executors, administrators, legal representatives and successors. Neither party may assign this Agreement, or any of its rights or obligations hereunder, without the prior written consent of the other party and any such attempted assignment shall be void, except that either party may assign this Agreement and/or any of its rights and/or obligations hereunder, without the other party's consent, upon written notice to the other party, to any company that acquires all, or substantially all, of the assets of the party seeking to make the assignment. 8. WITNESSETH WHEREAS, Benson and the County entered a Memorandum of Understanding dated April 14, 1999, which provides an allocation of 22,000 gpd in wastewater capacity in the Benson wastewater system for Meadow School and for businesses and residences with failed or failing septic systems in the Meadow area, WHEREAS, under the Benson -County Memorandum of Agreement, wastewater is to be delivered to the Benson system through a force main on NC 50 South and Morgan Road (S.R. 1211), and WHEREAS, Benson, the County, and the Town of Clayton entered an agreement dated May 17, 2005, which provides a wastewater capacity allocation of 150,000 gpd to the County in the Benson wastewater system, and WHEREAS, under the Benson -County -Clayton agreement, wastewater is to be delivered to the Benson system through a force main on US 301 North and Hannah Creek Road (S.R. 1356), and WHEREAS, under the Benson -County -Clayton agreement, the County paid the Town $125,000 for future wastewater capacity, and WHEREAS, the County desires to provide public sewer service to the area zoned as Interstate Highway Overlay District at the interchange of 1-40 and NC 96 in the Meadow area. NOW, THEREFORE, in consideration of the mutual covenants and promises set forth herein, Benson and County agree as follows: 1. In exchange for the $125,000.00 payment from the County to Benson, Benson agrees to transfer to County an additional wastewater capacity of 20,160 gpd, based on a current value of $6.20 per gpd of capacity. 2. County is deemed to own a total capacity of 192,160 gpd in the Benson wastewater system. 3. County may use up to 50,000 gpd of said wastewater capacity for wastewater services in the County service area south of Benson, with flow delivered to the Benson system via the NC 50 South force main. 4. County will limit its wastewater flow discharge into Benson's system from the north via the US 301 force main to 170,160 gpd until such time as the County and Benson agree for the County to purchase additional capacity. 5. County may reduce its wastewater discharge into Benson's system from the north via the US 301 force main in proportion to the daily volume of flow above 22,000 gpd which may be discharged into Benson's system from the NC 50 (South) force main. 6. County may use the wastewater capacity allocation for any purpose consistent with its zoning and sewer use policies; however, service to single family residences in subdivisions exceeding five (5) lots is prohibited. For the purposes of this agreement, a subdivision may not be separated into multiple phases to circumvent this provision. 7. Modification, Amendment, Supplement or Waiver. No modification, amendment, supplement to or waiver of this Agreement or any of its provisions shall be binding upon the parties hereto unless made in writing and duly signed by authorized representatives of both parties. 8. Severability. In the event any one or more of the provisions of the Agreement shall for any reason be held to be invalid, illegal or unenforceable, the remaining provisions of this Agreement shall be unimpaired, and the invalid, illegal or unenforceable provisions shall be replaced by mutually acceptable provisions, which being valid, legal, and enforceable comes closest to the intention of the parties underlying the invalid, illegal, or unenforceable provision. 9. Entirety of the Agreement. This Agreement constitutes the entire Agreement between the parties and supersedes all previous agreements included promises and representation, whether written or oral, between the parties with respect to the subjection matter hereof. Massengill, VayoC Town of Benson Memorandum of Agreement Between Town of Benson and Johnston County Concerning Availability of Wastewater Treatment Capacity and Lease of Wastewater Treatment Plant Effluent Nitrogen Credits General: The Town of Benson (hereinafter called the "Town") has a wastewater treatment plant with a capacity of 1.90 MGD (NPDES Permit No.N00020389). The Town and Johnston County (hereinafter called the "County") have existing wastewater agreements dated April 14, 1999, May 17, 2005 and June 25, 2009 for treatment of up to 192,160 gpd of wastewater from the County's system. Further, the County previously constructed pumping and piping improvements to deliver the County's wastewater to the Town's treatment plant. The Town's wastewater treatment plant currently has surplus treatment capacity and surplus effluent total nitrogen mass effluent limits. The County is planning an expansion of its wastewater treatment plant (NPDES Permit No. NC0030716), but until the expansion of the plant is complete and the County acquires additional total nitrogen effluent limit credits and/or expands its reclaimed water system, the County needs and desires additional wastewater capacity and effluent nitrogen limit credits on a temporary basis. The term of the interim period of need is five years. Agreement• The Town agrees to receive up to an additional 0.25 MGD of wastewater from the County system for treatment in its plant. The 0.25 MGD of treatment capacity will be provided with no capacity allocation charge since the period of availability is limited. The Town will charge the County for treatment of the additional wastewater under the terms of the June 25th 2009 agreement, however, notwithstanding the foregoing, the County shall pay to Town the current and prevailing rate charged by the Town for treatment of wastewater under this agreement. The Town shall lease to the County up to 10,000 Ibs/per year of effluent nitrogen allocation, as available by the Town and as needed by the County. The lease rate charged by the Town shall be based on the prevailing lease rate among members of the NRCA (Neuse River Compliance Association) at the time of the allocation to the County from Town. The agreement shall be effective on July 1, 2018, and shall extend for 5 years. The agreement will automatically renew in one year increments unless either party provides a written request for termination at least 30 days prior to the expiration date. Prioritv of Town Wastewater Needs: In event the Town requires either wastewater treatment capacity or effluent nitrogen limit credits during the term of this Agreement, with One Hundred Twenty (120) days written notice the Town may withdraw all or part of 0.25 MGD treatment capacity allocation and/or decline to lease or make provision of all or part of the 10,000 lbs. of effluent nitrogen. Third Party Approval: Lease of effluent nitrogen credits must be approved by the Neuse River Compliance Association (NRCA) under the terms of Permit No. NPDES NCC000001 and the by-laws of NRCA. County shall be responsible for ensuring this agreement is in compliance with all applicable standards promulgated by the NRCA and Town shall assist and facilitate County to obtain such compliance. Any cost associated with compliance with or reporting to the NRCA shall be borne by the County. Delivery of Wastewater: It is anticipated that County shall deliver to Town any wastewater to be treated under this Agreement at the US Highway 301 Force Main line which currently ties into the Town of Benson Wastewater/Sewer system.
