Hi Mr. Caughey, I have spoken with Andrew about this project, and we agreed to adjust the total wetland impacts to 0.099 acres. This will place you below the mitigation threshold for both the NCDEQ-DWR and the USACE. Any future impacts on this property will require mitigation. Please follow Andrew's instructions to fulfil the 401 requirements. Once a 401 certification has been issued, the Corps will issue you an after -the -fact Nationwide Permit 29. To begin the process of applying for the after -the -fact Water Quality Certification, you must submit a pre -filing meeting request. That may be done by sending an email to 40lPreFile(@deq.nc.gov and providing the following information in the body of the email: Project Name, County, Applicant Name, and Applicant Email. Once 30 days has passed since submittal of the pre -filing meeting request, you may submit your Pre - Construction Notification (PCN), which serves as the application for the Water Quality Certification. Good Morning, Thank you for meeting with me last Tuesday. As we discussed, we can move forward with issuing an after -the -fact Nationwide Permit 29 for Residential Development projects (see attached) for the work that has already been completed (Parcel number 9502-89-5670-000). This permit would authorize the 0.1 acres of wetland filling that has been conducted on the property. Any future wetland impacts would require you to submit a pre -construction notification to the Corps and would require compensatory mitigation in the form of payment to a mitigation bank for the loss of wetlands. Before we can issue the after -the -fact permit, you must receive a water quality certification from the state. Please work with Mr. Andrew Moore, cc'ed here, with the North Carolina Department of Water Resources to ensure you receive the necessary certification.
