The Division of Water Resources (DWR) received your request for a 401 Water Quality Certification (WQC) for the
subject project. The Pre -Construction Notification (PCN) requests after -the -fact authorization for 0.09 acres of wetland
impact. Per a July 13, 2023 email from the US Army Corps of Engineers, the total wetland impact on the project site is
0.099 acres. DWR plans to issue the after the fact WQC for 0.099 acres of wetland impact, rather than the 0.09 listed on
the PCN. If you have any concerns with this impact amount, please respond to this email.

PERMITTING for LAND DISTURBANCE and WETLANDS ENCROACHMENT, HEA MANAGEMENT
LLC.
This After -the -Fact PCN submittal is in response to the DWQ Notice -of -Violation (NOV-2023-CV-
0019) Failure to Secure 401 Water Quality Certification, Wetland Standards Violation, Transylvania
County, NC. A copy of the NOV Letter is attached.
The attached PCN Form and supporting documents have been uploaded at

The DWR Pre -Filing Meeting Requested has been requested via email to 401 prefile(a_ncdenr.gov
The project is located along the Little River, in Cedar Mountain, Transylvania County, NC.
