FACILITY SUMMARY
Auman Acres MHC, LLC operates a 100%domestic wastewater treatment plant for an estimated 90
residents.Auman Acres MHC WWTP is a minor facility(flow< 1 MGD)with a design capacity and
permitted wastewater discharge of 0.016 MGD. The original NPDES permit for this WWTP was issued in
June 1983. This facility utilizes the following treatment components:
• Three 3,000-gallon septic tanks with 1,000-gallon pump tanks.
• 6,000-gallon gravity fed septic tank
• 2,000-gallon detention tank
• 4,000-gallon final tank with two alternating pumps
• Dual surface sand filter

RENEWAL SUMMARY
This renewal contains the following changes:
• Updated the monthly average Ammonia Nitrogen winter effluent limits(for months November 1 —
March 31)based on 15A NCAC 02B .0404c.
• Updated electronic data submission requirements in Part I.A. (2).
• Ownership and name change throughout the permit from Auman Land LLC to Auman Acres MHC,
LLC and from Auman's Mobile Home Park WWTP to Auman Acres MHC WWTP,based on the
ownership change form signed March 1,2024
COMPLIANCE HISTORY
Auman Acres MHC WWTP has only one enforcement on record for Ammonia Nitrogen and flow limit
violations in July 2023. The facility has been issued five proceed to NOVs for Fecal and Ammonia
Nitrogen limit violations;three proceed to NODs for pH and Ammonia Nitrogen limit violations and two
proceed to NODS for late/missing DMR reporting violations; and three proceed to enforcement cases for
flow and Ammonia Nitrogen limit violations since the permit was originally issued in June 2019.
Most recent inspection(April 2022) showed the facility to be in compliance.
COMMENTS ON DRAFT PERMIT
• Jeffrey Talbott(Operator Certification Group)noted that the facility is classified as a WWBio-I
facility in BIMS,with no ORC holding a"backup ORC"role. Per 15A NCAC 08G .0201 —
Responsibility of System Owners to Designate Certified Operators:
Owners of classified water pollution control systems shall designate operators certified by the
Commission of the same type and grade as the classification for the system and for each
classification shall:
o (1)designate one ORC who possesses a valid certificate of the type and grade at least
equivalent to the type and grade of the system;
o (2)designate one or more Back-up ORC(s)who possesses a valid certificate of the type of
the system and no more than one grade less than the grade of the system,with the exception
of no Back-up ORC is required for systems whose minimum visitation requirements are
twice per year

• Edgar Miller(Executive Director/Riverkeeper—Yadkin Riverkeeper,Inc.) asked:
o Can the permit be denied if they have not paid any outstanding civil penalties?
o What new conditions in the permit will ensure better compliance w/permit limits going
forward?
After a discussion with the Central Office and the Winston-Salem Regional Office, Jenny Graznak
(Assistant Regional Supervisor)responded:
o First,the permit cannot be denied for outstanding civil penalties. Outstanding penalties go
through a collections process separate from permitting.
o Secondly,the permit fecal coliform limit will not change based on recent violations.
However,the regional office will continue to enforce compliance with the permit limits.
The most recent fecal coliform violations from the facility's December 2023 Discharge
Monitoring Report will be evaluated through the approved monthly violations assessment
process used by the Division.

Caroline and I discussed your questions below, and we wanted to jointly respond to them
since both permitting and compliance are involved.
First,the permit cannot be denied for outstanding civil penalties. Outstanding penalties go
through a collections process separate from permitting.
Secondly,the permit fecal coliform limit will not change based on recent violations. However,
the regional office will continue to enforce compliance with the permit limits.The most recent
fecal coliform violations from the facility's December 2023 Discharge Monitoring Report will
be evaluated through the approved monthly violations assessment process used by the
Division.

Hey Caroline,
I have a couple of questions about the second facility listed in this notice for the
Auman's Mobile Home Park WWTP. The new draft permit has been issued, but they
appear to have several outstanding NOV/NODs and I'm not seeing any documentation
that they have paid their most recent civil penalty.
1) Can the permit be denied if they have not paid any outstanding civil penalties?
2)What new conditions in the permit will ensure better compliance w/ permit limits
going forward? Particularly some of the higher fecal coliform violations.

NPDES Implementation of Ammonia Criteria-Update
NC has still not adopted an ammonia standard, though it is on our WQS Triennial List for next
round. NC did establish ammonia chronic criteria for use in NPDES permitting back in 1989/90,
which was based on EPA's 1986 criteria development document that factored in pH/Temp across
three regions of the State (see attached). This evaluation resulted in ammonia chronic criteria of
1.0 mg/l NH3-N (summer) and 1.8 mg/l NH3-N (winter) for use in permitting purposes. NC
implements these chronic criteria as Monthly Averages limits utilizing instream dilution. In
2002,NC developed procedures for complimentary acute permit limits (discussed below).
The current ammonia permitting procedures should be as follows:
• The NH3/TRC Wasteload Allocation(WLA) spreadsheet automatically calculates
appropriate ammonia Monthly Average limits for summer and winter. The spreadsheet
assumes a background ammonia concentration of 0.22 mg/1.
• For any permit (new/renewal), always run the NH3/TRC WLA spreadsheet to verify
appropriate Monthly Average Ammonia Limits for protection of aquatic life.
• If the allowable ammonia concentration is greater than 35 mg/l,no limit should be
imposed.
• If the allowable concentration is less than 35 mg/1,then the allowable limit is needed and
the spreadsheet will automatically calculate it.
• For Municipal facilities,the acute limit will be expressed as a Weekly Average, and is
based on multiplying the Monthly Average limit by a factor of 3.
• For non-Municipal facilities,the acute limit will be expressed as a Daily Maximum, and
is based on multiplying the Monthly Average limit by a factor of 5.
• If a new more stringent ammonia limit is required, discuss the need for a Compliance
Schedule with senior staff and then with the Permitee.
• There is no RPA procedure used for ammonia; it is implemented strictly based on WLA
spreadsheet results (similar to TRC).

• A sample NH3/TRC WLA is attached. In this example, the spreadsheet indicates that
Monthly Average ammonia limits of 3.2 mg/1 and 12.7 mg/1 should be imposed for
summer and winter, respectively, in order to protect for NC's chronic ammonia criteria.
Some additional considerations:
• This guidance will need to be revisited after NC formally adopts an ammonia standard for
both chronic and acute aquatic life protection.
• In the past, some ammonia limits were based strictly on protection of our DO standard
rather than ammonia toxicity, and that is why the permit writer should always verify the
correct ammonia limit with any permit renewal using the WLA spreadsheet.
• In the past, some practices allowed for maintaining a less stringent ammonia limit if the
facility was consistently passing the WET test(i.e., biology trumps chemistry). This is
no longer a valid approach and EPA would object. In April 2016 EPA expressly stated
that NC cannot use biology to override chemical results. EPA also disallowed the use of
Action Levels in permitting, in which toxicity test results (if passing) were used to
override the need for permit limits for copper/zinc/silver/iron/chloride.
