Sullins Director November 16, 2011 Natural Resources Dee Freeman Secretary Subject: Waiver of Monthly Reporting Requirement NPDES Permit NC0079090 Coldwater Trout Farm Graham County The Division has reviewed your request to suspend submission of monthly Discharge Monitoring Reports (DMRs)- After considering the recommendations of the staff in the Asheville Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective November 1, 2011. The DMRs un through (and including) October 2011 should be submitted as usual. Be advised that if and when any wastewater discharge occurs, the discharge must be monitored as per the termsof the NPDES permit and other applicable rules or statutes. Please keep the Asheville Regional Office apprised of any pertinent developments that arise regarding this facility, especially if the discharge is re -activated. While requirements for operator visitation, monitoring and reporting are being waived, you are still required to pay the Annual Administering and Compliance Monitoring Fee that is associated with this and all NPDES permits. We need to be sure that Mr. Hargis is aware that when/if the farm is reopened, reports must then be submitted. The water temperature has risen this past summer to more than 70 degrees causing significant loss of fish. Hopefully we are in a temporary weather cycle that will soon return to normal. As a result the farm is not being operated at this time. The water is turned off to the farm and no water is being diverted from Snow bird Creek through the farm. I request that I may be allowed to suspend Discharge Monitoring Reports until I am able to lease the farm to a prospective trout grower. I also request that my Discharge Permit continue in effect as I will be continuing my efforts to lease the farm. Please list me as the contact person until the farm is leased. I will advise you when the farm is back in operation and provide the name of the lessor and the new contact person.
