The Division has reviewed your submittal of the application for No Exposure Certification requesting exclusion from
NPDES stormwater permitting for the Nussbaum Center Properties, LLC facility located at 1431 South Elm-Eugene Street
in Greensboro, NC. Based on your submittal of a signed certification of no exposure, the site visit conducted by Aana
Taylor-Smith on February 17, 2014, and recent upgrades to the site, the Division is granting conditional exclusion from
permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North Carolina regulations.
Please note that by our acceptance of your No Exposure Certification, Nussbaum Center Properties, LLC is obligated to
maintain no exposure conditions at this facility. If conditions change such that the facility no longer qualifies for no
exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for any stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as unpermitted discharge.
Nussbaum Center Properties, LLC must recertify the no exposure status annually using the included form. Any "yes"
answer would require that you obtain NPDES permit coverage for stormwater discharge from the facility. The annual self-
recertification form does not need to be submitted to DEMLR, unless requested. Please note that this conditional
exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be
required under other federal, state, or local regulations or ordinances.

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter(with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DWQ must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"means
banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained
vehicles used in material handling;and final products, other than products that would be mobilized in
stormwater discharges(e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. in
addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual
outfalls. if any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CF R 122.26(g).

I understand that i am obligated to annually self re-certify No Exposure and, if requested,submit the re-certification to
DWQ or the operator of the local municipal separate storm sewer system (MS4) into which the facility discharges (where
applicable). I understand that I must allow the North Carolina Division of Water Quality, or MS4 operator where the
discharge is into the local MS4,to perform inspections to confirm the condition of no exposure and to make such
inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of

Please note: This application for the No Exposure Exclusion is subject to approval by the
NCDENR Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-215.6 8(i) provides that:
Any person who knowingly makes any false statement, representation,or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article;or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article;or who falsifies,tampers with,or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
[Environmental Management]Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine
not to exceed ten thousand dollars($10,000).
There is currently no fee for a No Exposure Exclusion.

An entity managed by D.H.Griffin Sr. has donated 9.2 acres along South Elm Eugene Street in Greensboro,including the 193,000-
square-foot former Carolina Steel Corporation industrial warehouse,to The Nussbaum Center for Entrepreneurship.
Steel Industries Inc. has owned the property since late 2005,public record shows.That entity is controlled by both Griffin,a veteran
Triad businessman who helms D.H.Griffin Cos.,and Jimmy D.Clark of moving engineering firm Guy M.Turner Inc.
The donated property spans 9.2 acres at 1431 S.Elm-Eugene St.just south of downtown Greensboro and is now owned by
Nussbaum Center Properties LLC.
Portions of the property,date back to 1920 and the total assessed valued for the land and building tops$2.2 million,according to
Guilford County tax records.The transaction dosed Dec.30.
The Nussbaum Center for Entrepreneurship is the state's largest small-business incubator. Sam Funchess,the center's president and
CEO,said the idea of the property donation first came up in 2009,when Nussbaum announced its plans to move from Revolution
Mill Studios on Yanceyville Street.(Revolution Mill is currently amid a large-scale renovation.)
Griffin,who also invested in Revolution Mill,was one of the donors who gave the Nussbaum Center its current home,another
former Carolina Steel building at 1451 S. Elm-Eugene St.
The Nussbaum Center made its move in June 2012.
"Back in 2009,when we were looking for a permanent home...(Clark and Griffin)showed us the building that we're in and said,'we
also own that over there....It may be in the future that we're Interested in donating that to you as well,-Funchess said of the
property at 1431 S. Elm-Eugene St."They said,'Is that something you can do something with?'We ran with that and said,'Yeah,

there's probably something we can do something with."'
Now the real fun and exploration begins.There's 15 football fields'worth of vacant industrial space and more than 9 acres to play
with,and Funchess is open to any and all ideas of how to use the space.
Some initial potential ideas include: Using the space as a soundstage for a film production("Why not?You're not going to find that
many enclosed buildings that size for as cheap as we can make it available,"Funchess said);building Class A or high Glass B office
space facing South Elm-Eugene Street with the rear of the property filled by advanced manufacturers;small-scale kitchen incubation
space for local-food startups and entrepreneurs;a brewpub or restaurant anchor on a retail site.
There's no set timeline for when the building and property will be transformed—and judging by the three-year timeframe of the
Nussbaum Center relocating to South Elm-Eugene Street,It's safe to say there won't be any serious action In the immediate future.
But Funchess wants to hear the community's ideas.
"The reality Is that we have the opportunity to either use a 200,000-square-foot building,or wd have the opportunity to remove that
to dirt and have a brand-new dean slate,and thafs the question:what do we want to do?"Funchess said,"What can the
community come up with?We have some ideas,but there are smarter people in this community than us,or at least more Creative
people,so let's chat and see what ideas we can see."

On July 8, 2011, the City of Greensboro Stormwater Management Division completed an
industrial compliance inspection of the Williams Steel Company. Local regulations permit an
inspection of industrial facilities under authority granted by City of Greensboro Code of
Ordinance Chapter 30, Article 12, Section 7.1 (C-5). This inspection consisted of two parts: a
review of the facility files/records and an on-site facility inspection.
The inspection was performed by Sherri Scalcione and Shameka Collins, and the following
deficiencies/observations were noted during the inspection.
