The Division has reviewed your submittal of the application for No Exposure Certification requesting exclusion from
NPDES stormwater permitting at Syntec Seating Solutions, LLC. Based on your submittal of a signed certification of no
exposure and on inspection by Aana Taylor-Smith on February 4, 2014, the Division is granting conditional exclusion from
permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North Carolina regulations. We
are also hereby rescinding your current permit Certificate of Coverage, NCG030634.
Please note that by our acceptance of your No Exposure Certification, Syntec Seating Solutions, LLC is obligated to
maintain no exposure conditions at this facility. If conditions change such that the facility no longer qualifies for no
exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for any stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as unpermitted discharge.
Syntec Seating Solutions, LLC must recertify the no exposure status annually using the included form. Any"yes" answer
would require that you obtain NPDES permit coverage for stormwater discharge from the facility. The annual self-
recertification form does not need to be submitted to DEMLR, unless requested. Please note that this conditional
exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be
required under other federal, state, or local regulations or ordinances.

on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter(with some exceptions) to
prevent exposure to rain, snow, snowmelf, and/or runoff.
For permitted facilities in North Carolina, DWO must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of,the current permit.
Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"means
banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained
vehicles used in material handling;and final products, other than products that would be mobilized in
stormwater discharges(e.g., rock salt).
A No Exposure Certification must be provided for each_facili y qualifying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
You are required to self re-certify your No Exposure Exclusion annualy.

discharge is into the local MS4, to perform inspections to confirm the condition of no exposure and to make such

Please note: This application for the No Exposure Exclusion is subject to approval by the
NCDENR Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation,or certification in any application, record, report, plan,or other
document filed or required to be maintained under this Article or a rule implementing this Article;or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article;or who falsifies, tampers with,or knowingly

On April 13, 2013, the above Certificate of Coverage was issued to Syntec Seating Solutions for
the discharge of stormwater from the 200 Swathmore Avenue facility. Below is a partial summary of
NPDES General Permit requirements. Please review the entire permit for other items that are applicable
to the Syntec facility.
Stormwater Pollution Prevention Plan: Part II, Section A of the permit requires the development of a
Stormwater Pollution Prevention Plan (SPPP). For existing facilities already operating, the SPPP should
be developed and implemented within 12 months of the effective date of the Certificate of Coverage or by
April 12, 2014. The SPPP should follow the outline specified in Section A. The SPPP may be prepared
in-house or you may retain the services of a consultant to assist you.
Analytical Monitoring Requirements: Part II, Section B. of the permit requires the semi-annual
collection of analytical samples (See Table 1) from each outfall during a measureable storm event.
Sampling must occur once during the period January — June and once during July -- December of each
year (See Table 2). In addition, benchmark values are established in the permit (See Table 3).
Exceedances of benchmark values require the permittee to take certain actions per the Tier 1, Tier 2 and
Tier 3 response actions. Samples analyzed per the permit must be reported to the Division on the proper
form no later than 30 days from the date the facility receives the sampling results from the laboratory.
On-Site Vehicle and Equipment Maintenance Monitoring: The analytical monitoring required by Part
Il, Section C of the permit is only required if Syntec Seating Solutions uses more than 55 gallons of new
motor oil and/or hydraulic oil when averaged over the calendar year.

Qualitative Monitoring Re uirements: Part II, Section D of the permit requires that semi-annual visual
inspections of each stormwater outfall be performed concurrent with the analytical monitoring:. These
qualitative records do not need to be submitted to the Division, however, the records must be kept on file
at the facility for a period of five years.
The analytical sampling and qualitative monitoring must begin immediately upon permit issuance.

In accordance with your application for a discharge permit received on March 18, 2013, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Per the requirements of the Randleman Lake Water Supply Watershed Buffer Rule, all
stormwater drainage to stream buffers, from portions of this site that have been constructed after.
April 1, 1999, must be discharged through a correctly designed level spreader or another device
that meets diffuse flow requirements per 15A NCAC 213 .0250. Diffuse flow requirements are
described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

This permit does not affect the legal requirements to obtain other permits which may be
fequired by the Division of Water Quality or permits required by the Land Quality Section of the
Division of Energy, Mining and Land Resources, Coastal Area Management Act or any other
federal or local governmental permit that may be required.

Tom -Sorry I missed you today. Observations of the outside of the building revealed that Syntec is not eligible for the
no exposure certification due to the following:
1) Industrial materials are being cleaned with a high pressure hose on the north side of the building [see Item 12(a) & (j)
of the checklist you submitted]. Note: The discharge of any type of wastewater onto the lands or into the waters of the
State without a valid permit is a violation of North Carolina General Statute 143-215.1. The discharge from the washing
operation must be ceased immediately. You options are to move the cleaning operation indoors or construct a cover
over the concrete pad and route all wastewater to municipal sewer.
2) The storage of equipment (rolling parts racks) outside in two locations [see Item 12(a) of the checklist].
3) Four uncovered roll off dumpsters on the west side of the building (see Item 12(i)of the checklist].
4) Storage of used pallets outside [see Item 16(a) of the checklist].
Since no exposure certification is not an option, Syntec needs to apply for NPDES permit coverage for the discharge of
stormwater. However, before sending an application I have one question. Does Syntec do any metal fabrication or just
auto fabric trimmings?

NCG03—Syntec Seating Solutions, LLC in Guilford County. The site discharges stormwater at 8 points to an unnamed
tributary to Muddy Creek (Class WS-IV;*). Muddy Creek is impaired for aquatic life and turbidity and has a TMDL.The
NOI is attached. Mike—I'm cc'ing you on this request since you've already had communications with this facility
regarding the permit.
Please let me know if the Winston-Salem Regional Office has any concerns about issuing a COC for a general for this
facility. Please also let me know of any potential impacts to wetlands. If we don't receive any objections, we'll issue the

The Division has reviewed your submittal of the No Exposure Certification form for Exclusion from
NPDES Stormwater Permitting, which we received on February 15, 2013. .The Division is unable to
'concur with your certification of no exposure.
Based on an inspection of your facility on February 28, 2013, the Winston-Salem Regional Office
staff found that industrial activities or materials on your site either are exposed, or have the potential to
be exposed. DWQ cannot grant your requested exemption from permit coverage due to the following: ;
1) Industrial materials are being cleaned with a high pressure hose on the 'north side of the
building [see Item 12(a) & 0) of the checklist you submitted]. Note: The discharge of any type
of wastewater onto the lands or into the waters of the State without a valid permit is a violation
of North Carolina General Statute 143-215.1. The discharge from the washing operation must
be ceased immediately. Options are to move the cleaning operation indoors or construct a
cover over the concrete pad and route all wastewater to municipal sewer.

2) The storage of-equipment (rolling parts racks) outside in two locations [see Item 12(a) of the
checklist].
3) Four uncovered roll off dumpsters on the west side of the building (see Item 12(i) of the
checklist].

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant sheiter(with some exceptions)to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DWO must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials r elude, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or was oducts.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"means
banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained
vehicles used in material handling;and final products, other than products that would be mobilized in
storm water discharges(e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
You are required to self re-certify your No Exposure Exclusion annually.

Dear Mr. Barnard:
The Division has reviewed your submittal of,the No Exposure Certification form for Exclusion from
NPDES Stormwater Permitting, which we received on February 15, 2013. The Division is unable to
-concur with your certification of no exposure.
Based on an inspection of your facility on February 28, 2013, the Winston-Salem Regional Office
staff found that industrial activities or materials on your site either are exposed, or have the potential to
be exposed. DWQ cannot grant your requested exemption from permit coverage due to the following:
1) Industrial materials are being cleaned with a high pressure hose on the 'north side of the
building (see Item 12(a)'& Q) of the checklist you submitted]. Note: The discharge of any type'
of wastewater onto the lands or into the waters of the.State without a valid permit is a violation
of North Carolina General Statute 143-215.1. The discharge from the washing operation must
be ceased immediately. Options are to move the cleaning operation indoors or construct a
cover over the concrete pad and route all wastewater to municipal sewer. }
2) The storage of-equipment (rolling parts racks) outside in two locations [see Item 12(a) of the i
checklist].
3) Four uncovered roll off dumpsters on the west side of the building (see Item 12(i) of the ;
checklist].
4) Storage'of used pallets outside [see Item 16(a) of the checklist].
Due to the above.industrial activities that are exposed to stormwater, Syntec Seating is obligated to }
immediately obtain a NPDES stormwater permit for the facility. The NGG030000 Notice of Intent form is
attached to this letter. Please complete the application and return it to the Raleigh address noted on #
page#4 of the farm on or before March 31, 2011'.

Tom —Attached is the application (a.k.a. Notice of Intent)for the NCG030000 stormwater permit for the metal
fabrication industry. The form should be completed and returned to the Raleigh address noted on page#4 on or before
March 31, 2013. Please forward a copy to my attention also.
A USGS Topo Map is attached as a required item per the application checklist. Also, as for the questions regarding
"Receiving Waters" in item #8 of the application, please use the following:

Since no exposure certification is not an option, Syntec needs to apply for NPDES permit coverage for the discharge of
stormwater. However, before sending an application I have one question: Does Syntec do any metal fabrication or just
auto fabric trimmings?
