Winston-Salem RpOonaifftc Oe National Pollutant Discharge Elimination System application for exclusion from a Stormwater•Permit-based on NO EXPOSURE: Submission of this No Exposure Certification constitutes notification that your facility does not require a permit for stormwater discharges associated with industrial activity in the State of North Carolina because it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter(with some exceptions) to prevent exposure to rain, snow, snowmelf, and/or runoff. For permitted facilities in North Carolina, DWO must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide by the terms and conditions of,the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained vehicles used in material handling;and final products, other than products that would be mobilized in stormwater discharges(e.g., rock salt). A No Exposure Certification must be provided for each_facili y qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. Below is a partial summary of NPDES General Permit requirements. Please review the entire permit for other items that are applicable to the Syntec facility. Stormwater Pollution Prevention Plan: Part II, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP). For existing facilities already operating, the SPPP should be developed and implemented within 12 months of the effective date of the Certificate of Coverage or by April 12, 2014. The SPPP should follow the outline specified in Section A. The SPPP may be prepared in-house or you may retain the services of a consultant to assist you. Analytical Monitoring Requirements: Part II, Section B. of the permit requires the semi-annual collection of analytical samples (See Table 1) from each outfall during a measureable storm event. Sampling must occur once during the period January — June and once during July -- December of each year (See Table 2). In addition, benchmark values are established in the permit (See Table 3). Exceedances of benchmark values require the permittee to take certain actions per the Tier 1, Tier 2 and Tier 3 response actions. Samples analyzed per the permit must be reported to the Division on the proper form no later than 30 days from the date the facility receives the sampling results from the laboratory. On-Site Vehicle and Equipment Maintenance Monitoring: The analytical monitoring required by Part Il, Section C of the permit is only required if Syntec Seating Solutions uses more than 55 gallons of new motor oil and/or hydraulic oil when averaged over the calendar year. These qualitative records do not need to be submitted to the Division, however, the records must be kept on file at the facility for a period of five years. Observations of the outside of the building revealed that Syntec is not eligible for the no exposure certification due to the following: 1) Industrial materials are being cleaned with a high pressure hose on the north side of the building [see Item 12(a) & (j) of the checklist you submitted]. Note: The discharge of any type of wastewater onto the lands or into the waters of the State without a valid permit is a violation of North Carolina General Statute 143-215.1. The discharge from the washing operation must be ceased immediately. You options are to move the cleaning operation indoors or construct a cover over the concrete pad and route all wastewater to municipal sewer. 2) The storage of equipment (rolling parts racks) outside in two locations [see Item 12(a) of the checklist]. 3) Four uncovered roll off dumpsters on the west side of the building (see Item 12(i)of the checklist]. 4) Storage of used pallets outside [see Item 16(a) of the checklist]. Guilford County Dear Mr. Barnard: The Division has reviewed your submittal of,the No Exposure Certification form for Exclusion from NPDES Stormwater Permitting, which we received on February 15, 2013. The Division is unable to -concur with your certification of no exposure. Based on an inspection of your facility on February 28, 2013, the Winston-Salem Regional Office staff found that industrial activities or materials on your site either are exposed, or have the potential to be exposed. DWQ cannot grant your requested exemption from permit coverage due to the following: 1) Industrial materials are being cleaned with a high pressure hose on the 'north side of the building (see Item 12(a)'& Q) of the checklist you submitted]. Note: The discharge of any type' of wastewater onto the lands or into the waters of the.State without a valid permit is a violation of North Carolina General Statute 143-215.1. The discharge from the washing operation must be ceased immediately.
