Skvada, III Govenor Director Secretary January 14, 2013 Old Castle Surfaces Attn: Bob Jackson 920 Old Winston Road Kemersville, NC 27284 Subject: No-Exposure Certification NCGNE0884 Old Castle Surfaces 920 Old Winston Road, Kernersville, NC 27284 Forsyth County Dear Mr. Jackson: William Messimer, Old Castle's Environmental Officer, recently requested a reevaluation of Old Castle's Kernersville location to ensure it still meets with the Division's requirements for No Exposure after some operational changes occurred at the facility that resulted in the storage of raw material and pallets in the outside yard without shelter from the elements. As such, Ron Boone, recently visited the site on January 10, 2013. Mr. Boone noted that there are several pieces of rough cut natural stone (granite) in the yard being stored in racks that keep them upright. These materials appear to be relatively clean and it appears to be unlikely that these materials would impart pollutants into rain water runoff that would adversely affect the receiving stream. There is also a stack of about 50 pallets of various sizes in the yard immediately adjacent to the rollaway dumpster. Mr. Messimer informed Mr. Boone that pallets are removed from the site on a weekly basis. Furthermore, Mr. Boone reports that the site was very clean and he noted nothing that presented a concern from a stormwater runoff standpoint. As such, the Division feels it prudent to allow Old Castle to continue with its current No Exposure Certification (NEC) and not require you to obtain a new stormwater permit. Accordingly, we will simply file the Notice of Intent recently submitted to the Division by Mr. Messimer for a new NCG070000 stormwater permit, and not process it. Thank you for being proactive and calling the Division for reevaluation of the site in response to operational changes. You may continue to operate under your current NEC (NCGNE0884). Please continue to strive to keep raw material and pallet quantities stored outside to a minimum. Also, please continue with your efforts to keep the site clean and free of materials that have the potential to contaminate stormwater runoff. If further operational changes occur at the site in the future, please do not hesitate to contact us for reevaluation. Your assistance and cooperation was greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. The facility is located at 2080 East 51h Street, in Winston-Salem, Forsyth County, North _Carolina, at approximate coordinates 36.0977290, -80.215068°. Stormwater related to industrial activity is discharged from the site via stormwater discharge outfalls (SDO) 001 and 002 to the City of Winston-Salem's municipal separate storm sewer system (MS4), eventually flowing to Brushy Fork, which is currently classified as a Class C water located in the Yadkin Pee-Dee River Basin. Documentation & Monitoring Review The Stormwater. Pollution Prevention Plan (SP3) and monitoring activities were reviewed. Some deficiencies were identified as enumerated below: 1. The general location map (Gl_M) does not show all SDOs with accurate latitudes and longitudes and does not indicate the receiving water and whether it is impaired. Please refer to Part 11, Section A, Paragraph 1(a).of the general permit. 2. The site map (SM) is not drawn to scale, doesn't show adjacent surface water (receiving stream, Brushy Fork), and doesn't indicate the percentage of each drainage area that is impervious. Please refer to Part II, Section A, Paragraph 1(c) of the general permit. 3. SDO certification, as required by Part 11, Section A, Paragraph 1(e) of the general permit, was accomplished in November, 2007. It has not been conducted since then. Please note that Part II, Section A, Paragraph 7, of the general permit, requires that the SDOs be recertified annually. The Spill Prevention and Response Plan (SPRP), as required in Part II, Section A, Paragraph 3, of the general permit, was found to be satisfactory except that Mr. Boone strongly suggests you add the following to your list of emergency contacts within your SPRP. a. NC Division of Water Quality, Surface Water Protection Section, Winston-Salem Regional Office (this office): 336-771-5000 b. Environmental contractors you would hire to aid in spill clean-up in the event of a large spill. c. City and County Environmental and Stormwater personnel. 5. The training program, as required by Part 11, Section A, Paragraph 5 of the general permit, was found to be satisfactory, however, it appears that not all personnel that should be trained, have been trained. Only five, four, and three people were trained, respectively in 2009, 2010, and 2011 and it appears that training just began in 2009. Please review Part II, Section A, Paragraph 5 of the general permit and reconsider what other employees should have the stormwater training. 6. SP3 annual reviews, as required-in Part 11, Section A, Paragraph 7 of the general permit, are being done but they are not documented. You must develop a way to document these annual reviews and any changes deemed necessary as a result of the reviews. 7. Although you stated that the site is generally inspected during the qualitative monitoring events and training events, there is no specific site inspection program as required by Part 11, Section A, Paragraph 8 of the general permit. Please.develop and implement a site inspection program that meets the intent of Part 11, Section A, Paragraph 8 of the general permit. 8. Qualitative monitoring (QM) is currently being done monthly, but is not being done during representative storm events (RSE). Please note that Part 11, Section B of the general permit requires QM to be done during RSEs as defined in Part 11, Section B. It is for this reason that it is strongly suggested that you acquire a rain gauge for the site. Also, please note that QM only needs to be accomplished semi-annually according to the specific schedule contained in Part 11, Section B of the general permit. Site Review I The site was fairly clean and well maintained. Mr. Boone noted only the following minor deficiency: 9. There was a pile of granite dust located within the raw product storage area on the southwest corner of the site. This dust could easily,be mobilized by a rain event and carried into the receiving stream. In addition, it could skew monitoring results. This dust should not be dumped on the ground and if it is, it should be cleaned up immediately. This should be a part of your Best Management Practices (BMP), Good Housekeeping and Preventative Maintenance, and Facility Inspection programs of the SP3. i Other Issues 10. You mentioned to Mr. Boone during.the inspection that the company would be moving to a new site located in Kernersville sometime within the next couple months. As a result, only the facility location information for your permit, or Certificate of Coverage (COC), will need to be changed. You will NOT be required to obtain a new COC for the new facility. As such, please let Mr. Boone know what the new address is as soon as you move to the new facility. At that point we will make the appropriate changes in our database to reflect the address of the new facility. However, you are reminded that you will have to update your SP3 and all related documents to reflect the conditions at the new facility. Being granted a NEC would preclude the need for the stormwater permit/COC and you would no longer be required to maintain the SP3 or conduct any of the inspections, monitoring, etc, required by the general permit. Attached to this letter is an application for NEC. Please review the application in detail. Filling out the application will determine, in part, whether you can qualify for the NEC.
