Based,on your submittal and signed certification of no exposure at the above referenced facility, the Division granted your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. It is important to note the following items pursuant to the No-Exposure Certification approval: 1) The uncovered dumpster at the rear of the facility contains scrap wood and some metal banding. Pursuant to the information you provided during the site inspection, this dumpster is emptied once or twice per week. Provided that this dumpster is emptied on that schedule (once or twice per week), and does not contain any other products such as paint or stain containers, chemical containers, or other prod uctslcontainers that could contaminate stormwater, then this would not violate the terms of the No-Exposure Certification. 2) The minor amount of saw dust on the ground at the rear of the facility is frequently removed. The remaining amount does not pose a threat to stormwater contamination provided that this good housekeeping practice is maintained on a frequent basis. There exists a vegetated filter strip between this area and the stormwater outfall that prevents any of this material from leaving the site. It is also important to maintain this vegetated filter strip. 3) Scrap metal drums can be stored outside provided that the lids are secured to prevent the collection of rainwater and also to eliminate any possibility of discharge from them. 4) Brand new (never used) wood pallets can be stored outside. Pallets that have been used in any manner must be stored inside or under roof. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained vehicles used in material handling;and final products, other than products that would be mobilized in stormwater discharges(e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. I found an Ornamental Products in Hickory but nothing for the facility in Archdale. Where did you send the application originally? It may not have been routed to the central office but if you still have the paperwork and would like to reapply,you can send it to me and I will get the process started. We submitted a permit exemption for our Archdale facility (Ornamental Mouldings, LLC-3804 Comanche Rd,Archdale, NC 27263) in December, 2009. 1 did not request a receipt notice since it was not time sensitive.
