RRO received this request on July 14,2010.The Division is unable to concur with your certification of no exposure. Based on an inspection of your facility on August 31, 2010, Raleigh Regional Office staff found that several materials on your site were exposed, along with the presence of a fueling pump station used for lawn mowers that has the potential for a petroleum release. Therefore, DWQ cannot grant your requested exemption from permit coverage. Instead,you are requested to apply for General Permit NCGO80000 for the Vehicle Maintenance facility. The TSD building had no material exposed, so met the NE expectations. However, numerous drums of exposed materials ranging from petroleum products to concentrated soap to an unopened drum of cooling towner biocide were observed around Veh Maint. There also exists a gasoline fueling pump with no secondary containment structure, used for fueling lawn mowers. This has a potential for a release. Accordingly, the request for NE was denied, and the facility manager was instructed to apply for NCGO80000 for the Vehicle Maintenance facility. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained vehicles used in material handling;and final products, other than products that would be mobilized in stormwater discharges(e.g., rock salt). A No Exposure Certification must be provided for each facilit qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion.
