Observations revealed that ECOFLO no longer qualifies for the exclusion from NPDES stormwater permitting due to the fact that waste electronics, open contaminated totes, uncovered roll off dumpsters, used pallets and numerous other materials are stored outside and exposed to precipitation. Previously, back on January 20, 2010, the Division of Water Quality (DWQ) sent a letter approving the conditional exclusion from stormwater permitting which was contingent upon ECOFLO maintaining no- exposure conditions at the facility. Obviously, that has not occurred. The letter further noted that if conditions change such that the facility can no longer qualify for the no-exposure exclusion, ECOFLO was obligated to immediately obtain NPDES permit coverage for any stormwater discharge. Please be aware that discharging stormwater into a tributary to South Buffalo Creek, Class "WS-V; NSW' waters in the Cape Fear River Basin without a valid stormwater permit is a violation of North Carolina General Statute 143-215.1, and could subject ECOFLO to enforcement action by this office. Per the federal Phase I permitting requirements established in 1990, [See 40 CFR 122.26(b)(14)(iv)], an individual stormwater permit is required for hazardous waste treatment, storage, or disposal facilities. To apply for an individual stormwater permit you will need to complete and submit EPA Form 1 and Form 2F (forms attached and also available at: http://portal.ncdenr.org/web/wq/ws/su/npdessw). The application fee is $860 per the attached fee schedule. The complete individual stormwater permit application package should be submitted to the following address on or before March 15, 2013. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter(with some exceptions)to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DWQ must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide by the terms and conditions of the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities Include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed,provided those containers are not deteriorated and do not leak. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained vehicles used in material handling;and final products, other than products that would be mobilized in stormwaler discharges(e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. Upon arrival at ECOFLO, each tanker truck and dump trailer will be visually inspected to identify leaks within the cargo area of the trucks. If visual indications of leaks are identified, the tanker truck/dump trailer will be moved under cover and the material will be transferred using the appropriate spill containment and health and safety procedures. When possible, incoming tanker trucks and dump trailers will not be offloaded during precipitation events. Should incoming tanker trucks and dump trailers require to be offloaded during precipitation events, the vehicle shall be moved under roof. Waste containers received at the front dock (under roof) are to be staged for QA/QC, barcoding and visual inspection (to identify leaks and/or possible corrosion). Once these procedures have taken place, the waste containers are to be processed or transferred to the appropriate storage/staging area within the facility (under roof) for processing at a later time. There are two designated non-hazardous storage areas (under roof) and seven hazardous storage areas (under roof) at the facility. The facility storage areas are set-up to keep the waste containers segregated by compatibility. Each storage area is designed to contain greater than 10% of the total volume of the stored containers. The storage areas consist of diked or bermed containment systems designed to contain leaking containers and spilled containers. No designated storage areas, at the facility, shall be located in areas exposed to precipitation. Open-topped roll-off boxes, metal recycling boxes, and/or trash hopers, stored outside of the facility (in the open operating area), shall be properly tarped or covered to reduce/eliminate exposure to precipitation events. 1 The operations at the Household Hazardous Waste Collection Center is currently partially under roof. As waste material is collected and packaged, full containers shall be closed and sealed for temporary storage. Once the container(s) is closed/sealed and deemed safe to move, onsite personnel will transfer the container(s) to the appropriate storage areas (under roof). During precipitation events any open containers will be temporarily sealed to minimize potential environmental exposures. When RCRA empty waste containers are stored in the open operating area they shall be properly marked, labeled, sealed and closed. In order to maintain a clean and safe working environment at the facility, the following work practices shall be used to maintain good housekeeping of the open operating area. The open operating area includes; Building 3, the hazardous waste roll-off box processing area, the tank farm and tanker truck loading and unloading area, the electronics storage area which consists of gravel, and the Household Hazardous Waste Collection Center. Before transporting containers (e.g. drums, barrels and tanks) to the appropriate storage areas, the containers must be cleaned to remove the remaining uncontainerized waste. Should visible waste material remain on the outside of the containers, the container shall not be stored in the open operating area of the facility but transferred to a sheltered storage area. RCRA empty containers stored outside shall be completely sealed. This means the lids, caps, rings, bolts, and bungs must be in place and secure to prevent rain water from entering the containers and all valves and taps are to be rendered inoperable. Containers that cannot be properly sealed must be kept under roof and not stored outside in the open operating area of the facility. The empty containers shall be neatly stored in rows with adequate aisle space to allow for daily inspection until the containers are picked-up for disposal or recycling. Pallets, used in the storage of RCRA empty drums, must be free of waste and/or debris so stormwater is not affected. Damaged or heavily stained pallets shall be removed from service upon being identified as such. The saw dust drift, from Building 3 operations, shall be swept up each day at the end of the shift and before any anticipated precipitation event. This will be done to ensure saw dust is not affecting storm water. 1 Any spills of waste materials shall be immediately contained and cleaned-up as well as any debris, oil drippings, dirt, paper, plastic, metal, etc. found on the concrete or asphalt open' operating area of the facility.
