Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the fallowing industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed,provided those containers are not deteriorated and do not leak. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained vehicles used in material handling;and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual outfalls. if any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. Sullins Dee Freeman Governor Director Secretary July 20, 2009 Mr. Jared Sousa Legacy Paddlesports 6012 High Point Road Greensboro, North Carolina 27407 Subject: General Stormwater Permit Inspection NPDES General Permit No. NCG190079 — Legacy Paddlesports Guilford County On July 16, 2009, Jenny Graznak of this office performed a Stormwater Permit Inspection at Legacy Paddlesports located at 6012 High Point Road in Greensboro, North Carolina. This facility holds General Stormwater Permit No. NCG190079 under the National Pollutant Discharge Elimination System (NPDES) to discharge Stormwater associated with activities classified as Ship and Boat Building. Legacy Paddlesports manufactures kayaks. You were present for the inspection. This type of inspection consists of two basic parts: a review of facility files and self-monitoring data and an inspection of the facility's discharge points. This particular inspection evaluated five (5) areas, and observations from each area are addressed below: 1. Permit The permit became effective September 1, 2004 and expires August 31, 2009. A copy of the permit was available during the inspection. 2. Records/Reports As required by the Permit, the facility has a complete Stormwater Pollution Prevention Plan (SPPP) that was available for review during the inspection. The SPPP, which was created by James Husted (Environmental Consultant, Husted & Associates, Inc.), appeared to be thorough and complete, including a location map of the outfalls and a site plan listing potential stormwater pollutants and best management practices used at the site. However, please note that Employee Training of the SPPP should occur on an annual basis. 3. Facility Site Review Legacy Paddlesports uses two-thirds of the building and a smaller portion of the outdoor space at this site. The other portion belongs to Daimler Buses, which has a separate Stormwater permit and outfalls. Outside, there is a covered dumpster, a recycling container for cardboard, and some steel racks (on the ground) on the Legacy property. No vehicle maintenance occurs on the Legacy site. Legacy also has a covered storage unit. It was determined during the visual inspection of the property that a condition of No Exposure would exist at this facility if the steel racks are moved or covered as was discussed during the inspection. No Exposure status requires that "All chemicals and materials at the facility are covered by a storm resistant shelter to prevent exposure to rain, snow, snowmelt, and runoff." However, Ms. Graznak observed during the inspection that Outfall #2 is actually draining Stormwater from the Daimler side of the property, not Legacy. Therefore, technically, it appears that Legacy Paddlesports has only one Stormwater outfall, #1, which is located at the bottom of a steep slope on the edge of the property line. No problems were noted. Stormwater from the property discharges to an unnamed tributary to the Bull Run Creek (Class WS-IV) in the Cape Fear River Basin. 5. Self-Monitoring Program The stormwater permit requires semi-annual qualitative and quantitative monitoring of stormwater discharge outfalls and effluent. An on-site review of the monitoring data during the inspection showed that all parameters were evaluated per the specifications of the permit. R&A Laboratories analyzes all samples. The last analytical monitoring even took place on November 11, 2007, with all results within permit limits. All qualitative monitoring is also performed as required by the permit. The last qualitative monitoring event occurred on October 17, 2008. No problems were noted. This office appreciates your efforts to comply with the Stormwater permit requirements.
