Conn, Environmental Coordinator Unichem, Inc. Post Office Box 612 Haw River, North Carolina 27258 Subject: NOTICE OF DEFICIENCY Stormwater Permit Inspection — NPDES Permit No. NCS000119 Unichem, Inc. —Alamance County Dear Ms. Conn: On November 25, 2008, Jenny Graznak of this office performed a Stormwater Permit Inspection at Unichem, Inc. located at 916 West Main Street in Haw River, North Carolina. This facility holds Stormwater Permit No. NCS000119 under the National Pollutant Discharge Elimination System (NPDES) to discharge Stormwater from industrial activities located at this site. As Environmental Coordinator for the facility, you'were present for the inspection. This type of inspection consists of two basic parts: an in-office review of facility files and self- monitoring data and an on-site inspection of the facility's discharge. This particular inspection evaluated five (5) areas, and observations from each area are addressed below: 1. Permit The permit became effective April 1, 2005 and expires March 31, 2010. A copy of the permit was available for review during the inspection. 2. Records/Reports As required by the Permit, the facility has a complete Stormwater Pollution Prevention Plan (SPPP) that was available for review during the inspection. The SPPP appeared to be thorough and complete, including a location map of the outfalls and a site plan listing potential stormwater pollutants and best management practices used at the site. The plan is reviewed and amended on an annual basis. Employee Training of the SPPP occurs on an annual basis. 3. Facility Site Review It was determined during the visual inspection of the property that a condition of No Exposure exists at this facility. All chemicals and materials at the facility are covered by a storm resistant shelter to prevent exposure to rain, snow, snowmelt, and runoff. Used pallets are stored outside on a temporary basis while awaiting pick-up for disposal: The only other items outside the facility are a covered dumpster, an air compressor, and a propane tank. Therefore, it is recommended that you apply for a No Exposure Certification for Exclusion from NPDES Stormwater Permitting. A No Exposure application is attached to this letter should you choose to proceed in that direction. If you wish, please complete and send the application to: Division of Water Quality Stormater Permitting Unit 1617 Mail Service Center Raleigh, NC 27699-1617 North Carolina Division of Water Quaiity 585 Waughtovm Street Phone(336)771-5000 Customer Service Intemet: hfp://h2o.enr.state,nc.us Winston Salem,NC 27107 FAX (336)771-4630 1-877-623-6748 Noy` Carolina An Equal OpportunitylAffirmative Action Employer—50%Recycled110%Post Consumer Paper Ntun7111f Ms. Conn ' Page 2 December 2, 2008 4. Effluent/Receiving Waters Stormwater from the property discharges to Haw River (Class C, NSW) in the Cape Fear River Basin. One outfall exists on the property, which accepts Stormwater from the roof drains and the employee parking lot. 5. Self-Monitoring Program The stormwater permit requires semi-annual qualitative monitoring and quarterly/annual quantitative monitoring-at stormwater outfalls. An on-site review of the monitoring data during, the inspection showed that visual inspections have been performed on a regular basis. However, you are delinquent in your analytical monitoring. Should you apply for and receive No Exposure Certification, your facility would be exempt from all monitoring requirements. On-site vehicle maintenance monitoring requirements at the site are waived regardless, since these activities are not performed on site. Please be aware that the failure to comply with monitorinq requirements is a violation of the General Permit. Therefore, this inspection report is a NOTICE OF DEFICIENCY. In order to avoid receiving a NOTICE OF VIOLATION you are required to either apply for a No Exposure Certification for Exclusion from NPDES Stormwater Permitting or comply with the permit re uirements as stated above and in the permit text. Conn h,C.Dem.of ENR Environmental Coordinator FEB 0 4 2005 Unichem Inc. P.O. Box 612 Winston-Salem Haw River,North Carolina 27258 Ftggionel once Subject: Draft NPDES Stormwater Permit Permit NCS000119 Unichem,Inc. Alamance County Dear Ms.Conn: Enclosed with this letter is a copy of the draft stormwater permit for your facility. Please review the draft very carefully to ensure thorough understanding of the conditions and requirements it contains. The draft permit contains the following significant changes from your current permit: • Quarterly Total Nitrogen(TN) and Total Phosphorus (TP) monitoring is required in the first year, and then annually For years 2-4. This monitoring is required because the facility discharges to a stream classified as Nutrient Sensitive Waters(NSW). If the data demonstrate this site is not a significant source of TN and/or TP, the facility may submit the first year's monitoring results and request a minor modification to remove TN and/or TP monitoring from the permit. • Total Flow monitoring has been removed;however, please note the permit still requires Total Rainfall amount and Rainfall Event Duration be recorded for each sampling event. This change is based on the Division's revised strategy for stormwater monitoring in renewal permits. Also, the Stormwater Pollution Prevention Plan(SPPP)site map must include drainage area for each outfall in acres and the percentage of each drainage area that is impervious (see Part 11,Section A). • TMDL(Total Maximum Daily Load) language has been added to Part II,Section B (below Table 2.)because this site discharges to an impaired water body. No monitoring based on a TMDL is required at this time, but if a TMDL is approved for the Haw River, this site may be asked to monitor for pollutants of concern in the future. The Division is incorporating TMDL language into all stormwater permits that discharge to impaired waters. Please submit any comments to me no later than thirty (30) days following your receipt of the draft. Comments should be sent to the address listed at the bottom of this page. If no adverse comments are received from the public or from you, this permit will likely be issued in about two months. Severe Property Damage Means substantial physical damage to property, damage to the control facilities which causes them to become inoperable,or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production. 24. Significant Materials Includes, but is not limited to: raw materials; fuels; materials such as solvents, detergents, and plastic pellets;finished materials such as metallic products;raw materials used in food processing or production; hazardous substances designated under section 101(14) of CERCLA; any chemical the facility is required to report pursuant to section 313 of Title III of SARA; fertilizers;pesticides;and waste products such as ashes, slag and sludge that have the potential to be released with stormwater discharges. 25. Significant Spills Includes, but is not limited to: releases of oil or hazardous substances in excess of reportable quantities under section 311 of the Clean Water Act(Ref: 40 CFR 110.10 and CFR 117.21)or section 102 of CERCLA(Ref: 40 CFR 302.4). 26. Stormwater Runoff The flow of water which results from precipitation and which occurs immediately following rainfall or as a result of snowmelt. 27. Stormwater Associated with Industrial Activity The discharge from any point source which is used for collecting and conveying stormwater and which is directly related to manufacturing, processing or raw material storage areas at an industrial site. Facilities considered to be engaged in "industrial activities" include those activities defined in 40 CFR 122.26(b)(14). The term does not include discharges from facilities or activities excluded from the NPDES program. 28. Stormwater Pollution Prevention Plan A comprehensive site-specific plan which details measures and practices to reduce stormwater pollution and is based on an evaluation of the pollution potential of the site. 29. Ten Year Design Storm The maximum 24 hour precipitation event expected to be equaled or exceeded on the average once in ten years. Design storm information can be found in the State of North Carolina Erosion and Sediment Control Planning and Design Manual. 30. Total Flow The flow corresponding to the time period over which the entire storm event occurs. Total flow shall be either;(a)measured continuously, (b) calculated based on the amount of area draining to the outfall, the amount of built-upon(impervious)area, and the total amount of rainfall,or(c)estimated by the measurement of flow at 20 minute intervals during the rainfall event. Part VI Page 4 of 5 Pages DRAFT Permit No. NCS0001 19 31. Total Maximum Daily Load TMDL A TMDL is a calculation of the maximum amount of a pollutant that a waterbody can receive and still meet water quality standards, and an allocation of that amount to the pollutant's sources. A TMDL is a detailed water quality assessment that provides the scientific foundation for an implementation plan. The implementation plan outlines the steps necessary to reduce pollutant loads in a certain body of water to restore and maintain water quality standards in all seasons. The Clean Water Act, section 303,establishes the water quality standards and TMDL programs. Information about the NC TMDL Program and a list of approved TMDLs for the state of North Carolina can be found at: http://h2o.enr.state.tx.us/tmdVGeneral_TMDLs.htm. 32. Toxic Pollutant Any pollutant listed as toxic under Section 307(a)(1)of the Clean Water Act. 33. U1pset Means an exceptional incident in which there is unintentional and temporary noncompliance with technology based permit effluent limitations because of factors beyond the reasonable control of the permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed treatment or control facilities, inadequate treatment or control facilities, lack of preventive maintenance,or careless or improper operation. 34. Vehicle Maintenance Activity Vehicle rehabilitation, mechanical repairs, painting, fueling, lubrication, vehicle cleaning operations,or airport deicing operations. 35. Visible Sedimentation Solid particulate matter, both mineral and organic, that has been or is being transported by water, air, gravity,or ice from its site of origin which can be seen with the unaided eye. 36. 25- ear,24 hour storm event The maximum 24-hour precipitation event expected to be equaled or exceeded,on the average, once in 25 years.
