A condition of no exposure at an Industrial facility means all industrial materials and activities are protected by a storm resistant shelter(with some exceptions)to prevent exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited ta: malarial handling equipment or activities, industrial machinery, raw materials, Intermediate products, by-products, final products, or waste products. Material handling activities Include the storage,loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities:drums, barrels, tanks, and similar containers that are tightly spalpd,provided those containers are not deteriorated and do not leak. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves; adequately maintained vehicles used in material handling;and final products, other than products that would be moblllzed in stormwater discharges(e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPOES permitting Is available on a facility-wide basis only--not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure- Certification form, you certify that a condition of no exposure exists at this facility or site and are obligated to comply with the terms and conditions of 40 CFR 122.26(g). VarTech Systems is a metal fabricator and manufacturer's industrial computer monitors. The only wet process operation from this facility consist of a water jet operation with a recycling system to recover garnet. Water and sludge is re-circulated through a separator that is next to the water jet unit. Mr. Easley said that sludge from the water jet is cleaned out every two weeks and disposed at the landfill. Mr. Easley said that about one 55-gallon container of this waste is disposed each time the unit is cleaned out. Discharges Outside the Building_At the time of inspection the unit was discharging overflow from the water jet reservoir through a pipe in the wall to two 55-gallon containers outside the building. Also, the separator unit inside the building was discharging into the two containers. The first 55-gallon container was overflowing at the time of inspection. x r k I Wastewater was being discharged from the second 55-gallon container through a 1-inch pipe. The pipe emptied at the edge of the parking lot. A large volume of wastewater was being discharged from the from the 1-inch pipe and from the overflowing 55-gallon container. Wastewater was observed flowing several hundred feet across the parking lot into a wooded area. � � •i. _ �r� rf r - ar �S Residue from the wastewater had noticeably accumulated on the pavement around the two 55-gallon containers. Garnet Sludge Disposal Area-An area at the edge of the parking lot had been used to dispose garnet sludge. Mr. Easley said that about six or eight 55-gallon containers of sludge had been disposed in the area about four months ago. The sludge had been covered or mixed with dirt. Also, a 4-inch pipe was observed in the area, which Mr. Easley said was discharging stormwater from the roof. Rear Loading Area—There was one 55-gallon container that was 2/3 full of dried garnet sludge on the loading dock. Some dried sludge was also observed on the asphalt next to the dumpster. Used Oil A petroleum based coolant is used in machines at the facility.One 55-gallon of used oil was observed in the Rear Loading Area. It was not labeled with the words"Used Oil." Universal Waste Fourteen 4-ft. and seven 8-ft. used fluorescent tubes that were not in containers were observed. I told Mr. Easley that these cannot be disposed at the landfill. Exit Interview I discussed with Wayne Prater, President, why the facility was discharging the garnet wastewater onto the parking lot and disposing sludge in the small dump area and at the landfill. He said that he did not believe there were any hazards based on the water jet manufacturer information. I told him he must have full knowledge of the constituents of the sludge, which may include chemicals from residues on the metals and other sources. I told him it would be necessary to make a waste determination by using generator knowledge or analytical testing. The waste determination must be fully documented. We discussed the facility EPA ID and that a subsequent notification had not been made, since the facility name is still listed as Enovation Graphic Systems, which previously used the building. Mr. Easley made a copy of the 8700-12 form and said he would submit the updated information.
