We are also hereby withdrawing your current permit number NCG080200. Please note that by our acceptance of your no-exposure certification, you are obligated to maintain no-exposure conditions at your facility. A condition of no exposure at.an Industrial facility means all industrial materials and activities are protected by a storm resistant shelter(with some exceptions)to prevent exposure to rain, snow, snowmelt,and/or runoff. A storm resistant shelter Is not required for the following industrial materials and activities:drums,barrels, tanks, and similar containers that are tightly sealed,provided those containers are not deteriorated and do not leak. "Sealed"means banded or otherwise secured and with locked or non-operational taps or valves; adequately maintained vehicles used in material handling;and final products, other than products that would be mobilized in storm water discharges(e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting Is available on a facility-wide basis only—not for Individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility Is not eligible for the no exposure exclusion. NOV Number: NOV-2008-PC-0271 Industrial Stormwater Permit— NCGO80200 Failure to Comply with Permit Conditions Buncombe County Dean Mr. Teague: On April 7, 2008, Chuck Cranford from the Asheville Regional Office of the Division of Water Quality (DWQ) conducted a site inspection at the Patton Cove Road location for East-West, Inc. in Swannanoa; NC. The inspection report indicated that you were present during the inspection visit. As a result of the site inspection and file review, the following violations were noted: I. Failure to develop and iniplement a Stormwater Pollution Prevention Plan II. Failure to conduct the required qualitative stormwater monitoring. Required Response This Office requests that you respond in writing within 15 days of receipt of this Notice. During the visit, company NCG08-related records were examined, operational activities and existing stormwater exposures were reviewed and discussed. Permit requirements were also reviewed as pertaining to the most recent permit version,dated November 1, 2007. A tour was conducted of the exterior of the facility, observing the stormwater conveyances and outfalls and site conditions. At the time of the inspection the site was found to be noncompliant with the permit. No SPPP had been developed nor implemented and no stormwater qualitative monitoring had been conducted. Upon review and discussion with DWQ staff following the inspection visit, two options seem appropriate to address permit noncompliance: 1. Develop and implement a SPPP including the required stormwater qualitative monitoring. Deliver the completed SPPP to the Asheville Regional Office. 2. Delay development of a SPPP and submit a No Exposure Certification for exclusion form. If a No Exposure exclusion is granted, no further action on the SPPP would be required at that time. Comply with the requirements of the No Exposure Certification.
