The Division has reviewed your submittal of the No-Exposure Certification for Exclusion from NPDES Stormwater
Permitting form. Based on your submittal and signed certification of no exposure at the above referenced facility, the
Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is
incorporated by reference in North Carolina regulations. We are also hereby withdrawing your current permit number
NCG080200.
Please note that by our acceptance of your no-exposure certification, you are obligated to maintain no-exposure
conditions at your facility. If conditions change such that your facility can no longer qualify for a no-exposure
exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no-
exposure exclusion expires in five years (February 15, 2014). At that time you must re-certify with the Division, or
obtain NPDES permit coverage for any stormwater discharges from your facility.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit
based on NO,EXPOSURE:
Submission of this No Exposure Certification constitutes notice that your facility does not require permit
authorization for Its stormwater discharges associated with industrial activity In the State of North
Carolina because it qualifies fora no exposure exclusion. A condition of no exposure at.an Industrial
facility means all industrial materials and activities are protected by a storm resistant shelter(with some
exceptions)to prevent exposure to rain, snow, snowmelt,and/or runoff.
Industrial materials or activities include,but are not limited to: material handling equipment or activities,
industrial machinery, raw materials,Intermediate products, by-products, final products, or waste
products. Material handling activities include the storage, loading and unloading, transportation, or
conveyance of any raw material, intermediate product, final product or waste product. A storm resistant
shelter Is not required for the following industrial materials and activities:drums,barrels, tanks, and
similar containers that are tightly sealed,provided those containers are not deteriorated and do not leak.
"Sealed"means banded or otherwise secured and with locked or non-operational taps or valves;
adequately maintained vehicles used in material handling;and final products, other than products that
would be mobilized in storm water discharges(e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion.
In addition, the exclusion from NPDES permitting Is available on a facility-wide basis only—not for
Individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the
facility Is not eligible for the no exposure exclusion. By signing and submitting this No Exposure
Certification form,you certify that a condition of no exposure exists at this facility or site and are_
obligated to comply with the terms and conditions of 40 CFR 122.26(g).
You are required to-reapply for the No Ex osure Exclusion once every five 5 ears.

I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document(except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to submit a no exposure certification farm once every five (5)years to the North Carolina
Division of Water Quality and, if requested,to the operator of the local municipal separate storm sewer system(MS4) into
which the facility discharges(where applicable). I understand that I must allow the North Carolina Division of Water
Quality,or MS4 operator where the discharge is into the local MS4,to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under

NCDENR Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
Inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-216.6 B(i) provides that:

On April 7, 2008, Chuck Cranford from the Asheville Regional Office of the Division of Water
Quality (DWQ) conducted a site inspection at the Patton Cove Road location for East-West, Inc. in
Swannanoa; NC. The inspection report indicated that you were present during the inspection visit.
As a result of the site inspection and file review, the following violations were noted:
I. Failure to develop and iniplement a Stormwater Pollution Prevention Plan
II. Failure to conduct the required qualitative stormwater monitoring.
Required Response
This Office requests that you respond in writing within 15 days of receipt of this Notice. Your
response should be sent to both to the attention of Chuck Cranford, Division of Water Quality,
2090 US HWY 70, Swannanoa, NC 28778 and to the attention of Mr. John Hennessy at the

An opportunity may exist to receive a No Exposure Certification for the Swannanoa facility. If the
Certification were granted, an Industrial Stormwater Permit would not be required, relieving you
of the Stormwater Pollution Prevention Plan and qualitative stormwater monitoring requirements
listed above. Please note: the No Exposure Certification must be renewed every five years and is
not transferable. Also, if site conditions or business practices change you must contact the
Division of Water Quality and an industrial stormwater permit may once again be required.
Thank you for your attention to this matter. This Office is considering sending a recommendation
for enforcement to the Director of the Division of Water Quality regarding these issues and any
future/continued violations that may be encountered. Your above-mentioned response to this
correspondence will be considered in this process. These violations and any future violations
are subject to a civil penalty assessment of up to $25,000.00 per day for each violation.

Inspection Summary:
DWQ staff was met on site by Mr. Robert Teague. During the visit, company NCG08-related records were examined,
operational activities and existing stormwater exposures were reviewed and discussed. Permit requirements were also
reviewed as pertaining to the most recent permit version,dated November 1, 2007. A tour was conducted of the exterior
of the facility, observing the stormwater conveyances and outfalls and site conditions. At the time of the inspection the
site was found to be noncompliant with the permit. No SPPP had been developed nor implemented and no stormwater
qualitative monitoring had been conducted.
Upon review and discussion with DWQ staff following the inspection visit, two options seem appropriate to address permit
noncompliance:
1. Develop and implement a SPPP including the required stormwater qualitative monitoring. Deliver the completed SPPP
to the Asheville Regional Office.
2. Delay development of a SPPP and submit a No Exposure Certification for exclusion form. If a No Exposure exclusion
is granted, no further action on the SPPP would be required at that time. Comply with the requirements of the No
Exposure Certification.

Your facility holds a general permit from the North Carolina Division of Water Quality to
discharge stormwater associated with industrial activities performed at your facility. Please be
advised that the Asheville Regional Office will be performing NPDES stormwater inspections
sometime in the near future.
If this office has not previously inspected your facility, you should be prepared to demonstrate
compliance with all terms and conditions included in the permit. Specifically, we will be
evaluating the following: your stormwater pollution prevention plan, stormwater outfall
locations, qualitative and analytical':monitoring data and any other activities required by your
permit. Please note that any data reported to the State must be analyzed by a facility that has a
North Carolina laboratory certification, either as a full laboratory or as a facility certified to
