Dear Mr. Mack Wiggins,
In May of 2002, I submitted a request form for No Exposure Certification for
Exclusion from NPDES Storm Water Permitting, in hopes that we would be exempt
for Storm Water testing. I have sent several letters and left messages on Shannon
Langley voicemail concerning this issue and have no yet received any kind of
response. I do understand that your division has been very busy, but we have
worked very hard to eliminate all of our outside storage so that we would not have
to continue the Storm Water Program. It has been almost a year since I have
submitted this request. I have asked help from Leggett's Corporate Environmental
Department, to assist me as to what steps to take next. Theresa Block contacted
your department on 3-17-03 to get some idea as to what the status is on this request.
She was told that we should re-send the No Exposure Certification for excluding
from NPDES Storm Water Permitting Form back to the Water Quality Division at
your attention. A copy will also be sent to the office in Winston-Salem to the
attention of Corey Basinger.
Attached is a copy of the No Exposure Certification form along with the first
memos sent in to Mr. Langley for him to review our case to start the process of
excluding us from storm water permitting.
It would be greatly appreciated if you could find out the status of our request
and where we stand to become exempt from the Storm Water Program. Please
contact me if any further information is needed and I will look forward to hearing
from you.

A condition of no exposure exists at an indusiriat facility when all industrial materials and activities are protected by a storm resistant shelter to prevent
exposure to rain,snow,snowmen, anclor runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities,
industrial machinery, raw materials,intermediate products, by-products, final products,or waste products. Material handing=Nrities include the vxxne,
loading and unloading, transportation, or conveyance of any raw material,intemwdiate product, final product or waste product. A storm resistant shelter is
not required for the following industrial materials and activities:
drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not feak. 'Sealed'
means banded or otherwise segued and without operational taps or valves;
— adequately maintained vehicles used in material handling;and
— final products,other than products that would be mobilized in storm water discharges(e.g.,rock saft).
A No Exposure Certification must be provided I&each facifrty qualifying for the no exposure exclusion. In addition, the exclusion from NPDES pertttitdng is
avadauble an a faciltty-wide basis only,not for ineividual outtalk. If any industrial activities or materials are or will be exposed to precipitation,the facility is
not eligible for the no exposure exclusion.
By signing and submitting this No Exposure Certificatlon form,the entity in Section A is certifying that a condition of no exposure exists at its facility or site,
and is obligated to comply with the terms and condidons of 40 CFR 122.28(g).

Back in May I sent in documentation requesting to be exempt from storm water
testing and resubmitted the forms on June 21, 2002 with the proper signature on it. On
August 28, 2002 we receive the renewal application to fill out in order to keep our
permit. I spoke with Bill Mills at the central office and he explained to me the cut backs
this department has taken. I do understand that you are short handed, but if there is any
way to review our case to start the process of excluding us from storm water permitting,
it would be greatly appreciated. We have worked hard to eliminate and cover our outside
storage.

Several attempts have been made, from phone calls and letters, by us trying to
find out the status of our request to be exempt from stormwater testing. A form, NO
Exposure Certification for Exclusion from Stormwater Permitting, was filled out and sent
into your department for review and response back in May of 2002. 1 have not received
anything on this request to know what steps need to be taken to conclude this issue. The
fees for our permit will be due in the next couple of months and I would like to know
where we stand in order to relieve us of this responsibility. I know that you are very

Several attempts have been made, from phone calls and letters, by us trying to
find out the status of our request to be exempt from stormwater testing. A form, NO
Exposure Certification for Exclusion from Stormwater Permitting, was filled out and sent
into your department for review and response back in May of 2002. I have not received
anything on this request to know what steps need to be taken to conclude this issue. The
fees for our permit will be due in the next couple of months and I would like to know
where we stand in order to relieve us of this responsibility. I know that you are very
busy, but if there is any way to review our case to start the process of excluding us from
stormwater permitting, it would greatly be appreciated. We have worked very hard to
eliminate and cover our outside storage.

Dear Mr, Langley
Back in May I sent in documentation requesting to be exempt from storm water
testing and resubmitted the forms on June 21, 2002 with the proper signature on it. On
August 29, 2002 we receive the renewal application to fill out in order to keep our
permit. I spoke with Bill Mills at the central office and he explained to me the cut backs
this department has taken. I do understand that you are short handed, but if there is any
moray to review our case to start the process of excluding us from storm water permitting,
it would be greatly appreciated. We have worked hard to eliminate and cover our outside
storage.
Attached is a copy of the No Exposure Certification for Exclusion from NPDES
Storm Water Permitting that was sent back in June. Please contact me and let me know
the status on our request and I will look forward to hearing from you.

testing and resubmitted the forms on June 21, 2002 with the proper signature on it. On
August 28, 2002 we receive the renewal application to fill out in order to keep our
permit. I spoke with Bill Mills at the central office and he explained to me the cut backs
this department has taken. I do understand that you are short handed, but if there is any
way to review our case to start the process of excluding us from storm water permitting,
it would be greatly appreciated. We have worked hard to eliminate and cover our outside
storage.
Attached is a copy of the No Exposure Certification for Exclusion from NPDES
Storm Water Permitting that was sent back in June. Please contact me and let me know

Dear Mr. Mack Wiggins,
In May of 2002, I submitted a request form for No Exposure Certification for
Exclusion from NPDES Storm Water Permitting, in hopes that we would be exempt
for Storm Water testing. I have sent several letters and left messages on Shannon
Langley voicemail concerning this issue and have no yet received any kind of
response. I do understand that your division has been very busy, but we have'
worked very hard to eliminate all of our outside storage so that we would not have
to continue the Storm Water Program. It has been almost a year since I have
submitted this request. I have asked help from Leggett's Corporate Environmental
Department, to assist me as to what steps to take next. Theresa Block contacted
your department on 3-17-03 to get some idea as to what the status is on this request.
She was told that we should re-send the No Exposure Certification for excluding
from NPDES Storm Water Permitting Form back to the Water Quality Division at
your attention. A copy will also be sent to the office in Winston-Salem to the
attention of Corey Basinger.
Attached is a copy of the No Exposure Certification form along with the first
memos sent in to Mr. Langley for him to review our case to start the process of
excluding us from storm water permitting.
It would be greatly appreciated if you could find out the status of our request
and where we stand to become exempt from the Storm Water Program. Please
contact me if any further information is needed and I will look forward to hearing
from you.

NPDES Storm Water Permitting
Submission of this No Exposure Certification constitutes notice that the ernity iaertrffed in Section A does not require permit authorization for its storm water
discharges associated with industrial activity in the State icentified in Section B under EPA's Storm Water Multi-Sector General Permit due to the existence
of a condition of no exposure.
A condition of no exposure exists at an industriai facility when all industrial materials and activities are protected by a storm resistant shelter to Prevent
exposure to rain, snow, snowmett, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment or aclfvMes
industrial machinery, raw matenals, intermediate products, by-products, final products,or waste products. Material handling activities include the storage,
loading and unloading, transportation,or conveyance of arry raw material,intermediate product, final product or waste product. A storm resistaw sheker is
not required for the following industrial materials and activities.
drums, barreis, tanks, and similar containers that are tfghtty sealed, provided those containers are not deteriorated and do not leak. 'Sealed-
means banded or otherwise secured and without operational taps or valves;
- acequately maintaineo vehides used in material handling;and
- final products,other than products that would be mobilized in storm water discharges(e.g., rock salt).
A No Exposure Cari fication must be provided for each facility qualifying for the no exposure exclusion. In addiction,the exclusion from NPDES permitting is
available an a facility-vide basis only, not for individual outfatls. If any industtiai activities or materials are or will be exposed to precipitation,the facility is
not eligible for the no exposure exdusion.
By signing and submitting this No Exposure Certffication form, the emity in Section A Is certifying that a condition of no exposure exists at its facility or site,
and is obligated to comply with the terms and conditions of 40 CPR 122.26(g).

Several attempts have been made, from phone calls and letters, by us trying to
find out the status of our request to be exempt from stormwater testing. A form, NO
Exposure Certification for Exclusion from Stormwater Permitting, was filled out and sent
into your department for review and response back in May of 2002. I have not received
anything on this request to know what steps need to be taken to conclude this issue. The
fees for our permit will be due in the next couple of months and I would like to know
where we stand in order to relieve us of this responsibility. I know that you are very
busy, but if there is any way to review our case to start the process of excluding us from
stormwater permitting, it would areatly be appreciated. We have worked very_ hard to
eliminate and cover our outside storatre.

Back in May I sent in documentation requesting to be exempt from storm water
testing and resubmitted the forms on June 21, 2002 with the proper signature on it_ On
August 28, 2002 we receive the renewal application to fill out in order to keep our
permit. I spoke with Bill Mills at the central office and he explained to me the cut backs
this department has taken. I do understand that you are short handed, but if there is any
way to review our case to start the process of excluding us from storm water permitting,
it would be greatly appreciated. We have worked hard to eliminate and cover our outside
storage.
Attached is a copy of the No Exposure Certification for Exclusion from NPDES
Storm Water Permitting that was sent back in June. Please contact me and let me know
