Please make sure to copy DWR on the final photo submittal of the riprap removal for upstream and downstream of the culvert. Please be aware that all impacts must be within the square footage approved in the issued buffer authorization from 4/27/2023. This includes 7,266 SF in Zone 1 and 4,525 SF in Zone 2 for the road crossing. If you find that placement of the riprap has exceeded the approved amounts, you will need to submit an updated amount for review. Please also provide documentation that the SCM is located outside of the 50-foot buffer (Requested in the 5/3/24 email below). If you have any questions, please let me know. Stream was re-channelized from the outlet FES to the downstream channel. Left side of channel riprapped for bank stability. Right side re -graded and plan to riprap sides as well. The riprap should only be the amount required for dissipation, should not widen the natural stream channel, and must not exceed the approved area stated within the issued 401 certification and buffer authorization. The currently issued 401 certification and buffer authorization only approved, a culvert and dissipater pad within a 117 LF impact area, not a stormwater dissipater/scour hole with the current riprap placement/totals. If your intent was for a scour hole design at the downstream end of the culvert and can demonstrate that the currently constructed impacts have been designed to proper specifications, then we can discuss a situation where you could submit a permit modification request to potentially obtain approvals. Please also provide documentation that the SCM is outside of the 50-foot riparian buffer zones. If the foot print is within this area (temporary or permanent), you will need to also modify the buffer authorization via a new application. Please ensure that you copy DWR on all correspondence regarding your plan of restoration for DWR approval by May 31, 2024. If you have any questions or would like to discuss, please let me know. Landon, Thank you for the quick response the compliance inquiry. The stream crossing as built is out of compliance with the General Conditions for the NWP-14 issued, May 3, 2023. Your response lays out the main issue with the as built project, "Sides were also armored to existing ground level per the NCDEQ Land Quality detail for stormwater dissipator pads". The construction here appears to be a stormwater dissipator, this is a stream crossing. I have attached NWP-14 conditions; regional general condition 9 specifically addresses culverts. Part A of that condition addresses culvert burial with which I believe you are compliant, Part C addresses channel modification "Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity...." In summary, rip -rap upstream and downstream of the culvert to armor the crossing was indeed authorized, but the permit drawings nor the PCN describe the impacts as the exist today. To return the project to compliance with NWP-14 the stream bed and channel should be returned to a grade and width similar to the natural grade. I do understand this was an incised channel and rip -rap installation does require some level of laying the banks back, but the basin as it exists is multiple times wider than the native stream bed width. A restoration plan should be submitted to this office by May 31. Once a restoration plan is agreed upon, the restoration should be completed within 30 days of approval of a restoration plan. If you would like to meet onsite to discuss a time can be arranged within the next week or two. If no restoration plan is submitted or if compliance is not actively being addressed an official card letter will be issued. The permit had 117 linear feet of stream impacts for the culvert and rip -rap to armor. I this large catch basin design that was used to armor the downstream side of the culvert is not shown in the permits. A dissipator pad was installed at the outlet of the 60" pipe to prevent erosion of the channel. The length of the dissipator was included in the permit impact length and should have been better identified on the impact plans. Since the pipe is buried below the stream channel, the tail end of the dissipator slopes up slightly to the natural stream bed channel creating a bowl shape which is expected to fill in with time creating a more natural channel. Sides were also armored to existing ground level per the NCDEQ Land Quality detail for stormwater dissipator pads. Please reference attached copy of the Impact Drawings, with lengths of Impact further described (SEE Attached) This designed was mirrored on the upstream side as well at about half the scale The existing stream channel is very narrow with steep slopes and riprap was installed on the upstream side of the pipe to protect the inlet from washing out and to tie back in to the natural grade. and both upstream and downstream sides seem to be impeding the flow of water at low flow level. We will be glad to remove some of the riprap where the existing channel ties in both upstream and downstream to prevent impedance of stream flow. Please advise to what extent is acceptable. The storm water catch basin was also not in the permit and it was unclear where it falls in relation to the wetlands, This is a temporary sediment skimmer basin that was installed outside of the existing wetland areas which were surveyed prior to site design. The basin is temporary and will be removed when construction is complete and groundcover is fully re-established. there are multiple flagging tapes all over the site from construction. There seems to be a lot of work on going so this would be a time to address these issues before project completion. Thank you for your attention to this matter, Shane Shane F.
