S.DANIEL SMITH NORTH CAROLINA Director Environmental Quality May 28, 2024 Ms. Elisa Triplett, WWTP Superintendent City of Lenoir, Public Utilities PO Box 958 Lenoir,North Carolina 28645 Subject: Draft NPDES Permit Modification Permit NC0023981 Lower Creek WWTP Caldwell County Grade IV Biological WPCS SIC Code 4952 Dear Ms. Triplett: Enclosed with this letter is a copy of the Draft NPDES permit modification for your facility. Please review this draft carefully to ensure thorough understanding of the requirements and conditions it contains. Changes from the existing permit include the following: • Based on review of the submitted Water Effects Ratio (WER) study for evaluation of site- specific Total Silver limits and results of a reasonable potential analysis run on effluent silver data against the current limits and those recommended by the WER study and finding a reasonable potential to exceed the WER-based allowable concentrations, Total Silver limits and monitoring have been revised [See A.(1.)]. • Based on the potential issuance of this modification with an effective date coinciding with the effective date for the Total Silver and Total Zinc limits per the current compliance schedule, the Total Silver and Total Zinc compliance schedule has been removed from the permit in this modification. The numbering of permit conditions has been adjusted accordingly. • Based on the above compliance schedule removal, the footnote referencing it has been removed from the effluent sheet, and the compliance date of August 1, 2024 was inserted for the final Total Zinc limits [See A.(1.)]. • To allow the Permittee the option to continue using WER-based allowable concentrations for Total Silver limit development in the next permit cycle, a special condition requiring the Permittee to conduct and submit the results of a WER study confirmation test for review with the permit renewal application [See A.(5.)]. The NPDES standard conditions(Parts II, III, and IV)that are a part of the permit are not included in this draft document (cover, map, and Part I). The conditions are the same as in your current permit except that agency and division names have been updated. The latest version is available at https://bit.ly/3k5NFaL and can be viewed online or downloaded as a PDF file.
