In response to your request to renew the subject NPDES permit (received March 20, 2023), the Division
of Water Resources (DWR or the Division) hereby transmits this draft permit for your review and
comment. Please review this document carefully to assure your understanding of the permit limits and
monitoring conditions, and to correct errors, if any.
Concurrent with this notification, the Division will solicit public comment on this draft by publishing a notice
in newspapers having circulation in the general Pamlico County area, as required by the NPDES Program.
Please provide your written comments, if any, to me, Joe R. Corporon, P.G. Uoe.corporon@deq.nc.gov] no
later than July 2, 2024 (approximately 30 days after receiving this document). Your written comments are
welcome, but they are not mandatory.
The NPDES standard conditions (Parts II, III, and IV) are part of this permit but are not included in this
draft document (cover, maps, and Part I only). The latest version of Parts II, III, and IV is available at
httns://bit.lv/3k5NFaL and can be viewed online or downloaded as a PDF file.
The Division understands that Garland F. Fulcher's Seafood Company, Inc. (GFS or the Permittee) has
maintained previously designated outfalls, as spectated subparts under Federal Regulations 40CFR 408
discharging to a receiving stream classified Salt Water / Nutrient Sensitive Waters /High Quality Waters
[SC; NSW; HQW].
DWR addresses these outfalls herein as:
• Outfall 001 Crab Processing (Manually Processed Blue Crab, 40CFR 408, Subpart B]
• Outfall 002 Shrimp Processing (Non -Breaded Shrimp Processing [40CFR 408, Subpart L]
• Outfall 003 Fish Processing (Manually Processed Bottom Fish [40CFR 408, Subpart U]
• Outfall 004 Non -Process -Contact Boiler Blowdown
Compliance Reporting - Lapses in Discharge Activity. Compliance requires GFS to monitor, sample, and
report separately the discharge from each designated outfall. If an outfall is not active during a given
report month or calendar quarter, the Permittee shall report non -activity on monthly eDMRs as "no flow"
or "no discharge." Failure to report subjects GFS to civil penalty assessment.

Estimated Production - GFS's renewal application offers no data for production and limited data for
discharge flow [see Application, pg. 4]. Therefore, as best professional judgement (BPJ), the Division has
calculated renewal limits based on historically reported averaged production and flows considering a
seasonal / episodic discharge [see Fact Sheet and permit sections A. (L) through A. (4.)].
New Limits for Oil & Grease (O&G) and Total Suspended Solids (TSS) — As required by current
Permitting Guidance, the Division compared Federal 40CFR technology based effluent limits (TBELs)
with North Carolina water -quality based effluent limits (WQBELS) to establish which is more protective.
This comparison concludes that previous TBEL limits are less stringent than WQBELs and therefore less
protective of the receiving stream [see Fact Sheet, Tables 001B, 002B, and 003B]. It follows that DWR
has applied WQBEL limits for the parameters Oil and Grease (O&G) and Total Suspended Solids (TSS)
to all production -designated outfalls [see permit sections A. (1.) through A. 3].
High Ouality Waters (HOW) -- As further required by current State Regulations [I 5A NCAC 02B
.0224 HQW (1) (b) (vii)], DWR has applied protection for HQW adjusting permit limits to % the
calculated value for each O&G and TSS limit [see Fact Sheet, Tables 00113, 002B, and 003B]. We have
also updated Dissolved Oxygen (DO) limits to the minimum 6.0 mg/L at all production outfalls [15A
NCAC 02B .0224 (1)(b)(i)].
NOTE — New Units of Measure - Renewal limits for O&G and TSS require analyses and reporting in
concentrations as milligrams per liter (mg/L). This replaces previous units in mass in pounds per day
(lbs/day) - see permit sections A. (1.) through A. (3.).
Total Residual Chlorine (TRC). Total Nitrogen (TN). and Total Phosphorus (TP) — TRC monitoring
continues Monthly, to be sampled `only if' chlorine or chlorine derivatives are used to disinfect. For TN
and TP, monitoring continues Quarterly [see permit sections A. (L) through A. 3.)], as required by Neuse
River Basin Permitting Guidance.
Following the mandatory 45-day public comment period, the Division will review all pertinent comments,
if any, and take appropriate action prior to issuing an NPDES permit final. If you have questions or

to receiving waters designated as Raccoon Creek [Oriental Harbor] within the Neuse River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth
in Parts I, II, III and IV hereof.
This permit shall become effective

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number is no
longer effective. Therefore, the exclusive authority to operate and discharge from this facility
arises under the permit conditions, requirements, terms, and provisions described herein.
Garland F. Fulcher Seafood Company, Inc.
is hereby authorized to:
1. continue to operate wastewater treatment facilities in support of seafood packing and
processing from a facility located at the Garland F. Fulcher Seafood Company, Inc., 301
Hodges Street, Oriental, Pamlico County; and
2. discharge from said treatment works via Outfall 001(crab-processing), Outfall 002
(shrimp -processing), Outfall 003 (fish -processing), and Outfall 004 (boiler blowdown),
at a location specified on the attached maps, into Raccoon Creek [Oriental Harbor;
stream index number 27-129-8], a waterbody currently classified SC; HQW, NSW within
hydrological unit 03-04-10 [HUC: 030202040603] of the Neuse River Basin.

A. (5.) SPECIAL OPERATING CONDITIONS
[G.S. 143-215.66]
(a) Best Management Practice (BMP) Requirements:
(1) There shall be no discharge of fish parts or floating solids. Discharge shall contain
no foam visible in other than trace amounts.
(2) Permittee shall direct employees and provide resources to implement, at a
minimum, such practices that wastewater volume and wastewater constituents are
reduced, as follows:
• Dry cleanup shall be performed prior to washdown of the facility.
• Personnel shall be instructed to stop water flow through idle equipment.
• All process and washdown equipment shall be fitted with high pressure/low
volume nozzles.
• All on -demand water delivery hoses shall be fitted with automatic shut-off
nozzles.
(b) Dry Clean-up Requirements:
1) All batter drippings shall be collected in pans under the breading tables.
2) Spilled batter shall be squeegeed off the floor prior to wet cleanup.
3) Permittee shall not allow batter residuals to be discharged to surface waters; all left
over batter and solids shall be collected in a container and properly disposed.
4) Where practical, trays shall be placed under machines and conveyor belts to collect
particles of breading or other food products.
5) Employees shall be instructed to remove, by hand or other method, leftover
breading from sifters and other machines prior to these solids entering the drainage
system.
6) Flooring shall be brushed with a stiff broom prior to wet cleanup.
A. (6.) USE OF BIOCIDE
[G.S. 143-215, 143-215.1]
The Permittee shall use no biocide(s) other than those approved by the Division for this
specific discharge. Should the Permittee intend to use a new biocide not previously approved, a
request for approval must be submitted to the Division no later than 90 days prior to its intended
first use. The Permittee's approval request shall include both an accurately completed Biocide
Form 101 and a Material Safety Data Sheet (MSDS) for each proposed biocide.

A. (7.) ELECTRONIC REPORTING - DISCHARGE MONITORING REPORTS
[G.S. 143-215.1(b)]
Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program
reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21,
2015.
NOTE: This special condition supplements or supersedes the following sections within Part II of this
permit (Standard Conditions for NPDES Permits):

Section E. (5.) Monitoring Reports
1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)]
The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic
Discharge Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted monthly electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. The eDMR system may be accessed
at: https:Hdeq.nc.gov/about/divisions/water-resources/edmr.
If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband access,
then a temporary waiver from the NPDES electronic reporting requirements may be granted and
discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms
approved by the Director. Duplicate signed copies shall be submitted to the following address:

Monitoring results obtained during the previous month(s) shall be summarized for each month and
reported via the eDMR system no later than the last calendar day of the month following the completed
reporting period. Regardless of the submission method, the fast DMR is due on the last day of the month
following the issuance of the permit or in the case of a new facility, on the last day of the month following
the commencement of discharge.
Starting on December 21, 2025, the permittee must electronically report the following compliance
monitoring data and reports, when applicable:

Sewer Overflow/Bypass Event Reports; and
Pretreatment Program Annual Reports; and
Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver
from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of
each electronic submission. The permittee should use the EPA's website resources to identify the initial
recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA
or the state authorized by EPA to implement the NPDES program) that is the designated entity for
receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each
type of electronic submission and for each state. Instructions on how to access and use the appropriate
electronic reporting tool will be available as well. Information on EPA's NPDES Electronic Reporting

Electronic submissions must start by the dates listed in the "Reporting Requirements" section above.
3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an
electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to the
Division. Requests for temporary electronic reporting waivers must be submitted in writing to the
Division for written approval at least sixty (60) days prior to the date the facility would be required under
this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not
exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted
electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic
reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only
permittees with an approved reporting waiver request may submit monitoring data and reports on paper to
the Division for the period that the approved reporting waiver request is effective.

4. Signatory Requirements [Supplements Section B. (11.) (b) and Supersedes Section B. (11.) (d)]
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II,
Section B. (I 1.)(a) or by a duly authorized representative of that person as described in Part 11, Section B.
(I 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting
purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account
and login credentials to access the eDMR system. For more information on North Carolina's eDMR

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make the
following certification [40 CFR 122.22). NO OTHER STATEMENTS OF CERTIFICATION WILL BE
ACCEPTED:
"1 certify, under penalty of law, that this document and all attachments were prepared under my direction
or supervision in accordance with a system designed to assure that qualified personnel properly gather
and evaluate the information submitted. Based on my inquiry of the person or persons who manage the
system, or those persons directly responsible for gathering the information, the information submitted is,
to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant
penalties for submitting false information, including the possibility of fines and imprisonment for knowing
violations."
5. Records Retention [Supplements Section D. (6.)]
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions.
These records or copies shall be maintained for a period of at least 3 years from the date of the report.
This period may be extended by the request of the Director at any time [40 CFR 122.41 ].
