Thankyou for reaching out to Lincoln County Planning&Inspections today!We certainly understand the need for
the request for zoning compliance verification by the lending institution. It is quite common, but is also a very
important part of the work we do. It is important that we treat these requests carefully to provide the most
accurate information backto the requesting party.
The entitlement of the property at Parcel 93153 (Cambridge Village) in the spring of 2016 included the designation
of the property as a Planned Development—Commercial project,which under the provisions of the county's
Unified Development Ordinance(Article 2.4.9 and Article 3.8) requires compliance with both general development
standards and specific standards related to stormwater management as set forth by the applicable state agencies
—North Carolina Department of Environmental Quality(NCDEQ).Admittedly,this project does not fall within a
locally protected watershed and is not subject to all of the specific stormwater requirements in Article 7- Natural
Resource Protection. However, it does fall within the State of North Carolina's Post Construction Stormwater
regulatory boundary and therefore requires compliance with standards that are referenced and specifically called
out in the county's Unified Development Ordinance under Article 3.8.
With the site being under NCDEQ jurisdiction, it is not the county's responsibility to inspect or permit the
stormwater structures on the property; however, it is within the purview of the county to ensure that the standards
called for within the development ordinance pertaining to these types of commercial projects are met.The
purpose of our request for official communication to be provided by the state regulatory agency(NCDEQ) is an
effort to establish compliance. Once the status of the ongoing repair of the BMP(stormwater pond) and its
compliance with state standards is certified by a state official,then at that point the standards required by the
county's LIDO will be considered to have been met. It is at this time that our department here locally can in good
faith, issue an "in compliance"zoning confirmation letter for the property.

Joshua,We have asked for a very simple (and common) request for a zoning confirmation letter from
Lincoln County planning for our Publix shopping center in Denver. I am not sure if your additional
requests is warranted to provide a letter of zoning confirmation. It is coming off to me as blackmail,
which I take highly offensive. Let me know if you do not intend to provide the letter today.

The pond is in the middle of being completely redone and synthetic liner is being
installed. Construction is underway with it. See attached progress pictures from a couple
of weeks ago. The weather has to corporate with us to finish. We expect to be finished in
about 3 weeks. NCDEQ is aware of what we are doing. Let me know any additional
questions.

I'm in receipt of your message regarding the zoning letter request. Can you provide an
update regarding the storm water pond that is managed by a permit with the state?The
latest communication I believe we had seen here in the office was from NCDEQ
Mooresville Regional Office who needed to conduct an inspection to determine if there
were any leaks or malfunctions of the pond(s) on site.
Do you have any written communication from NCDEQ Mooresville Regional Office from the
results of that inspection? I think we could use to that help get you the zoning letter.

I hope all is well. We are refinancing our Publix Shopping Center, Cambridge Village, and the lender
has requested a zoning letter confirming the parcel is in compliance with the zoning. It is parcel
PIN 4602631955. Is this something you can provide?
