The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on February 20, 2024. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. As designed, the provided swales do not meet the design requirements outlined in 15A NCAC 02H .1003(2)(c)(i). The provided side slopes, 2:1, are steeper than the maximum allowable of 3:1 (no engineering calculations/on-site soil investigation showing that the 2:1 slopes will remain stable in perpetuity was provided). Please revise as needed. Ditch calcs are revised using 3:1 side slopes and 7.90 in/hr intensity. 2. Please correct the following issues with the swale drainage area map plan sheet (drainage features in the plan set are required per 15A NCAC 02H .1042(2)(g)(iv)): a. The drainage area information for swales 1, 2, & 3 have two sets of impervious area values (one of the values, 1,382.54 sf appears to have been copy&pasted as it appears in each of the drainage area callouts). Please revise as needed. Typo for 1,382.54 sf is corrected for Swales 1, 2&3 on Drainage Area Delineation Sheet. b. The slope for swale 4 is shown on this plan sheet as 1.10%whereas it is shown as 1.07% in the other submittal materials. Please revise as needed. Swale Slope 4 is revised to 1.07%on Drainage Area Delineation Sheet and is consistent with revised Ditch Calculation Spreadsheet. Please correct the following issues with the calculations (calculations are required per 15A NCAC 02H .1042(2)(f)): a. Please provide a source for the rainfall intensity value used in the equation. Per NOAA Atlas 14 data (available here: https://hdsc.nws.noaa.gov/pfds/pfds_map_cont.html), the 10-year, 5-minute rainfall intensity is approximately 7.90 in/hr for this location. Please revise as needed. The original source was NOAA Atlas 14 data for Monroe, NC but was not address specific.The intensity is revised to 7.90 in the ditch calculation spreadsheet. b. Please indicate how the composite rational coefficient, C, value was computed for the different drainage areas. If an equation was used to calculate the C value based on the pervious and impervious areas of the drainage area,you can just include the equation used under the table. Please revise as needed. A sample calculation is provided on the revised dictch calculation spreadsheet. 4. Please correct the following issues with the O&M Agreement Form (This item is required per 15A NCAC 02H .1042(2)(j)): a. Please indicate the type of low-density project that this is in the drop-down menu next to "Type:" on the Low-Density line of the form. The form uses macros to generate the correct information based on what is entered into the cover page of this form. Selecting"Vegetated swales/roadside ditches" as the type removes the curb-outlet swale O&M requirements (which were included in the provided O&M Agreement Form) if the project does not have curb-outlet swales. Please revise as needed. The Macro does not appear to be working,so we are unable to load the proper sheet that excludes the curb-outlet swales information.We received the excel spreadsheet from your office.The form is corrected,signed&included. 5. Please correct the following issues with the Supplement-EZ Form: a. Cover Page: i. Line 7—Please include the width of the vegetated setback from surface waters required per 15A NCAC 02H .1017(10). It is noted that there are no surface waters located on-site, however we ask that this value be included on this form (Lines 8 & 9 can remain as "N/A"to indicate that there are no surface waters located on-site). We included the minimum 30'setback stipulated in 15 NCAC 02H.1017(10)in Line 7 of the Cover Page. b. Drainage Areas Page: i. General—Provided surface areas only need to be precise to the whole square foot (the permittee may find it difficult to verify BUA areas to that level of precision). ii. Line 19—This item is not needed for a low-density project. e We reformatted the cells to show only whole square footage on the Drainage Area Page. d. Low-Density Page: i. Line 4— See earlier comment with regard to swale side slopes. ii. Line 12—This item is required per 15A NCAC 02H .1003(4)(e). iii. Swale design information and Line 5 —Revise as needed, see earlier comment with regard to swale side slopes. Line 4 is corrected to 3:1 Max Side Slopes.Line 12 is answered.Line 5 is revised based on the maximum flow from the revised ditch calculation spreadsheet. 6. Please provide a Response to Comments letter indicating, in a point-by-point manner, how each of the above comments has been addressed. This item is required per 15A NCAC 02H .1042(3)(b). This letter with red letter responses serves as the Response letter. Also, in response to your May 20, 2024 (4:01 pm) email regarding the permitee's email address: The email provided in the form is correct. The email address in the forwarded and copied emails "chickeisl0@fronter.com" should be chickeisl0@frontier.com 7. Provide PDFs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other documents, and a response to comments letter briefly describing how the comments have been addressed. a. PDFs must be uploaded using the form at: https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload b. Hard copies must be mailed or delivered to the following address: i. For FedEx/UPS: Jim Farkas 512 N. Hand Delivery: Please reach out to me prior to hand delivering a submission to make sure that I (or someone else in my group)will be able to receive the submission. Do not leave the package in the foyer with the security guard. NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay the review process and the submission package may be lost while being sent from the Regional Office to me in the Central Office. To ensure a fair, timely, and transparent review process, any disagreement with provided comments will need to be addressed in writing as part of the requested information resubmission, within the required resubmittal window. The merits of the disagreement will be reviewed during the next scheduled technical review and, if applicable, will be addressed in further requests for additional information. If the resolution provided by the reviewer is found to be unsatisfactory, the applicant can agree in writing to a longer review period, during which the dispute will be brought to the technical review committee and a final determination will be made. Due to staffing limitations and to ensure an efficient project review, requests for individual meetings to discuss provided comments are decided at the discretion of the reviewer. We encourage you to carefully review the written feedback provided and the applicable rules. The NCDEQ Stormwater Design Manual provides additional insight into design criteria. Any questions or further requests for clarification should be submitted in writing in the requested information resubmission, within the required resubmittal window. We appreciate your understanding and cooperation in this streamlined process. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to June 19, 2024, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW3240203 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
