This was also sent to USACE on 1/27/2016. Evidently, our proposed fill hatching was not clear. Sorry about that. The dashed lines represent the County minimum building setbacks and the shaded area is proposed fill. Thanks, Brian Brian D. Rubino, P.G. Please see revised PCN (#3d) and the site plan which includes a shaded hatch over the proposed fill area and septic tank note based on our discussion. When asked about septic setbacks from wetlands I answered with 35 ft for advanced pretreatment systems but that is incorrect for Ocracoke. In Hyde County, all Albemarle Regional Health Counties and most other coastal counties, the 35 ft is from coastal wetlands or “marsh” as described in the on-site septic regs, and is not from Section 404 non-coastal wetlands. If this were in Dare County, this would be different based on their interpretation of these rules, but just about every other coastal county requires a min 5 ft setback from 404 currently. Please let me know if you need a hardcopy of this information sent to you or if you have any other questions or requirements. Thanks, Brian Brian D. Rubino, P.G.
