Properties, LLC, please find below and attached the additional information you requested in your letter dated January 28, 2016. 1. Confirm the correct spelling of Mr. Langdon's last name. The application lists Langden, but the agent authorization form lists Langdon. The correct spelling of the applicant/owner's name is Devaul Dess Langdon. (This was mistakenly spelled "Langden" with an "e" on the application.) We apologize for this error. 2. Provide the number ofparking spaces required by the Town of Cary and the number ofparking spaces proposed for the project. Table 7.8-1 of Section 7.8.2 of the Town of Cary Land Development Ordinance requires that for Office, Business or Professional space 1 parking space is required for each 300 SF of office space. Our building consists of 3 stories, each 3,500 SF, for a total of 10,500 SF. 10,500 SF / 300 SF per space = 35 parking spaces. Per Table 7.8-4 of the LDO the Town also requires 2 handicapped spaces for parking areas consisting of 26-50 spaces total. The Town does allow handicapped parking to count towards the fulfillment of parking requirements. Our plan proposes a total of 35 parking spaces, the minimum required by the Town. 3. This office believes the impacts to Zone I of the buffer could be minimized by realigning the dumpster at angle in the corner of the parking lot. Please revise the plan accordingly or explain why this realignment is not possible. During the preparation of our original design submittal we attempted to limit the buffer impacts including possible realignments of the dumpster pad but were unable to develop a solution that kept the dumpster (and parking) out of Zone 1 while at the same time meeting the parking requirements of the Town of Cary. Per DWR's request we have reconsidered this option and are still unable to find an alternative solution. See the attached figure. As you can see while it is possible to realign (angle) the dumpster pad and move it out of Zone 1, in doing so we lose parking spaces required by the Town. It must be remembered that the garbage truck will be required to back into the property from Laura Duncan Road and then turn to align itself with the dumpster. This new alignment and location requires the removal of parking spaces taking us down to 32 parking spaces. If additional spaces are added back in in the location where the dumpster pad had been located in the original site plan then these new spaces would result in more impacts in Zone 1 than the dumpster pad. Even with this change we are still short of the required 35 parking spaces. 4. Please explain how spills from the dumpster will be prevented from migrating into the riparian buffer. The proposed development is for an office building, so the likelihood of spills of any significance (such as grease, oils, or hazardous materials) from the dumpster is very low. That said the dumpster pad (as well as the entire parking lot area) are to be surrounded by curb and gutter. While not shown specifically on the plans the intent is to slope the parking lot such that it drains to a low point close to the proposed stormwater device to reduce the required length of stormwater pipe. As such any spills (or trash/debris for that matter) that did come from the dumpster would be directed towards the stormwater device and not the riparian buffer. 5. You have indicated that you are making a payment to a local mitigation bank or in -lieu fee program as your mitigation plan, please provide documentation from an appropriate mitigation bank or the Division of Mitigation Services indicating their willingness to accept your request to purchase buffer credit to mitigate for the proposed buffer impacts listed in your application. Attached is a Statement of Buffer Mitigation Credit Availability from Wildlands Holdings.
