Division of Water Resources’ Central and Regional staff has reviewed the application package
received on November 1, 2023, and additional information received on March 7, 2024. However, the
Division requires additional information before completing our review. Please address the items on the
attached pages no later than the close of business on June 21, 2024.
Please be aware that the Applicant is responsible for meeting all requirements set forth in North
Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the
review of the subject application package. The Division may return the application as incomplete pursuant
to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in
Sections A through N or the Applicant fails to provide the additional information on or before the above-
requested date.

1. Item V.20 – The property line separation distances provided in Item V.19 do not meet the setback
requirement of 50 feet for irrigation sites listed in 15A NCAC 02T .0606. The Site Map shows the
proposed drip irrigation area within 50 feet of the proposed private right of way (R/W). The
reviewer has noted that Person County has not yet subdivided the parcel and these values are based
on preliminary property and private R/W lines. Please address how the Applicant will verify and
meet setback distances to the proposed property and private R/W lines prior to the operation of this
facility.

G. Soil Evaluation:
1. Ms. Dorothy Robson of the Raleigh Regional Office (RRO) reviewed the revised Soil Evaluation
and provided the following comments:
a. KSAT Nests 1, 2, and 3 provide insufficient data points to determine steady state conditions. The
length of time does not indicate whether the KSAT locations achieved steady state as many
variables can occur that do not show up in reading intervals ranging up to 721 minutes (12
hours).
Please provide the peer-reviewed published methodology used to conduct the KSAT
measurements and how the consultant incorporated them into the Soil Evaluation. The
Division does not have a published methodology since peer-reviewed scientific methods are
available. The Division expects Applicants and their consultants to conduct KSAT
measurements in accordance with these peer-reviewed published methodologies.
