If you are requesting a modification on impact site #S4 from a rip -rap collar/apron permanent fill to permanent culvert stabilization, please submit a revised PCN with the complete impact summary table and final design plans. On the ENV-01 Impacts Replace_pg7_(attached), the stream width should be clearly depicted on the plans (only one blue line) as compared to the stream profile depicted in the ESC site plans (attached). A cross-section view of the culvert (inlet/outlet bench detail) should be provided. The 401 issued on 4-1-24 was according to the information listed in the PCN and the stream mitigation requested. The difference in this scenario was listing permanent stream fill as the impact type and not stabilization, stabilization does not require mitigation. Once the information is received, I'll issue the 401 modification. Let me know if additional assistance is needed. I am familiar with NCDOT permitting program and the same detail we are showing for stream stabilization at the inlet and outlet of the culvert (10381723-01CG112 01CG112_ Culvert _stabilzation_Additional_page_20240502) are considered temporary/permanent impacts with no mitigation. Please help me understand what is different, if anything, in this scenario. Please let me know how to proceed and if you would like to jump on a Teams call to discuss this further. Jessica, To better assist with your request, can you confirm where in the stream channel the rip -rap aprons will be installed? There will be no rip -rap aprons in the stream channel. We are in final design, and it has been determined keyed -in or embedded stone will be used and installed appropriately at the top and bottom of the culvert as a stream stabilization technique (10381723-01CG112 01CG112_Culvert_stabilzation_Additional_page_20240502). This is a stream stabilization impact as there was some scour at the top and bottom end of the existing culvert. This measure would help to stabilize the stream bed around the proposed culvert. I am requesting a change in this impact from rip - rap collar/apron permanent fill to permanent culvert stabilization. Please see the details attached. # 3a. Reason for 3b. Impact 3c. If that is correct, the mitigation required for the permanent stream impacts for the Project have not changed (141LF). *It should also be noted that the drawings depict the rip -rap aprons in very close proximity to an unnamed tributary (UT) located immediately south of the Project area. What E&S measures will be installed in this area to prevent impacts into the UT during construction? Please see the enclosed ESC plans (ESC_2024.05.06 Bethabara) for the culvert and adjacent UT. Hi Ryan, The permits were submitted at 60% design (due to emergency and road closure) and now we have final design which is showing embedded rip -rap at the inlet and outlet of the culvert. Based on this I would like to request a change in the issued 401 permit to reflect less permanent stream impact. The embedded rip -rap fill for inlet/outlet stabilization detail (10381723-01CG112 01CG112_ Culvert _stabilzation_Additional_page_20240502) and revised impact sheet (ENV-01- Impacts_Replace_pg7_20240502) are attached. Please note, the rip -rap would not exceed the stream bed elevation and would be "keyed" into the stream bed. Would you like me to request a formal modification through the ePCN process or can we do this through email? I will also request a new SOA from Kelly at DIMS for 72 linear feet after I hear back from you. Please let me know the best way to proceed. Hi Jessica, I've reviewed the request below and the PCN listed rip -rap collars as permanent, rip -rap fill. The total mitigable stream impacts requested for the project were 141 LF and the 401 WQC (attached) reflects that impact total. Due to the permanent loss of waters from the culvert and the rip -rap collars, the 1:1 mitigation ratio for the stream impacts is correct. I gave Ryan a call and, also Amy Chapman this morning. Importantly, I wanted to share the nomenclature for the rip -rap collar in our permit. These rip -rap areas, also known as rip -rap aprons are placed up and downstream of the culvert to discourage scour underneath the culvert. These are non- mitigable with USACE. Jennifer and I had some back -and -forth about it this morning. It is considered a low -quality stream so she required a 1:1 mitigation ratio. I initially assumed these rip -rap aprons were permanent, mitigable but now I see they may not be and onlyjust permanent with no mitigation. Please confirm this statement so that we may make the appropriate payment to DMS (either for permanent impact to 72 or 141 linear feet). There is a big price difference so I want to be sure we are following the correct pathway for mitigation. This project is going to be 100% in the next 60 days and start of construction very soon.
