Subject: Endangered Species Canourrence for Improvements to US 321 from SR 1370 (Kirby Mountain
Road} to SR 1500 (Blackberry Road), Caldwell County, North Carolina (TIP No. R-2237-B)
As requested by the North Carolina Department of Transportation, we have reviewed the natural
resattrees information and biological conclusion for federally protected species for the subject project.
Tht: following comments are provided in accordance with the provisions of section 7 of the Endangered
Species Act of 1973, as amended (1G U.S.C. 1531-1543) (Act).
We have reviewed the habitat assessment and survey information provided for impacts to the federally
threatened dwarf flowered heartleaf (Hexactylis rcaniflora}. Given the information provided, we agree
that there will be no effect to federally listed species for the subject project.
We believe the requirements under section 7{c) of the Act are fulfilled regarding listed species for the
subject project. However, obligations under section 7 ofthe Act must be reconsidered, if: (1) new
information reveals impacts of this idt:ntifieti action that may affect listed species or critical habitat in a
manner not previously considered, (2) this action is subseduerttly modified in a manner that was not
considered in this review, or (3) a new spccit:s is lislcd or critical habitat is determined that maybe
affected by the identified action.
