I have a follow up quesƟon about the culvert and aquaƟc life passage, especially with this being a trout stream. Figure 5.8 in the plans shows that the culvert will be placed at the streambed elevaƟon and not buried like is typically required. It looks like the slope of the culvert is 4.15%, so culvert burial is not required provided that all alternaƟve opƟons for flaƩening the slope have been invesƟgated and aquaƟc life movement/connecƟvity has been provided when possible (e.g., rock ladders, cross-vanes, sills, baffles, etc.). Please provide an explanaƟon of why the culvert cannot be buried, a descripƟon of alternaƟve opƟons invesƟgated for flaƩening the slope, and any measures to provide for aquaƟc life passage. The Division will consider this applicaƟon to be on-hold unƟl addiƟonal informaƟon is received. Please let me know if you have any quesƟons. Ms. Beyer, On February 13, 2024, the Division of Water Resources (Division) received your applicaƟon requesƟng a 401 Water Quality CerƟficaƟon from the Division for the subject project. The Division has determined that your applicaƟon is incomplete and cannot be processed. The applicaƟon is on-hold unƟl all of the following informaƟon is received: 1. Many of the labels on the project plans cannot be read. Please submit plans of sufficient quality that labels and features are clearly displayed. [15A NCAC 02H .0502(a)(9)] Please see the aƩached updated impact drawings. Several text boxes have been wriƩen over, and all other text should be legible upon zooming in. 2. The project plans appear to show an exisƟng culvert crossing of the stream; however, it is not menƟoned in the project descripƟon or history. The PCN menƟons an exisƟng gravel drive but does not include informaƟon on a culvert associated with this road. Please clarify whether an exisƟng culvert is present and whether it will be removed as part of this project. Please include applicable impact measurements. The pre-exisƟng culvert cannot be uƟlized due to several safety issues. It is also not proposed for removal at this Ɵme. 3. The PCN does not include a descripƟon of measures taken to avoid or minimize the proposed impacts in designing the project (the PCN says to see addiƟonal informaƟon following PCN form, but this quesƟon is not included in the addiƟonal informaƟon). Please include a descripƟon of these measures, including why 98 feet of 3 impacts are required and why the exisƟng culvert, if present, cannot be uƟlized. Please provide your response by May 10, 2024. If all of the requested informaƟon is not received, the Division will be unable to approve the applicaƟon and it will be denied as incomplete.
