Division of Water Resources’ Central and Regional staff have reviewed the application package
received on February 12, 2024. However, the Division requires additional information before completing
our review. Please address the items on the attached pages no later than the close of business on May 13,
2023.
Please be aware that the Applicant is responsible for meeting all requirements set forth in North
Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the
review of the subject application package. The Division may return the application as incomplete pursuant
to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in
Sections A through N or the Applicant fails to provide the additional information on or before the above-
requested date.
Please reference the subject application number when providing the requested information. The
Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and
submit an electronic response to my attention via the Non-Discharge online portal.

1. The issued minor permit modification will require the Permittee via Compliance Schedules in
Section I to submit the following items prior to the initial distribution of Class A residuals from the
Henry Fork WWTP’s proposed solids handling facility:
a. Finalized program information that includes the product information sheet for the consumer
per Instruction D of Form: DCAR 06-16 and 15A NCAC 02T .1109(c).
b. A final O&M Plan per Instruction H of Form: DCAR 06-16 and 15A NCAC 02T .1110 that
includes a more detailed sampling plan (i.e., diagram of sampling points) based on the
completed facility.
c. Residuals quality information (i.e., laboratory analytical reports/documentation for TCLP,
metals, nutrients/micronutrients, and PR/VAR).
No response is required.

2. Section 4.1 (General) – Please revise “NCDNR, Mooresville Regional Supervisor, Contact
Information” to “NCDEQ, Mooresville Regional Office, [phone].”
3. Section 6.2.2 (Sample Frequency) – Please revise the listed TCLP, ignitability, corrosivity, and
reactivity sampling frequency to “Annually.” Since the Henry Fork WWTP is a new facility for
the generation of Class A residuals, the Permittee will need to monitor the residuals for two years
at the frequency specified in Attachment A. Then the Permittee may submit a minor permit
modification request to reduce the frequency to “Once Per Permit Cycle.”

4. Residuals Management Plan – Section 1.2 (Residuals Characteristics) – The list of potential
residuals contributors here differs from the consortium listed under the Attachment A of the Final
Permit issued on August 19, 2019. Please confirm what facilities the Division should remove or
add (if any) and if the Division needs to update the ownership percentages/maximum dry tons per
year (DT/yr) in Attachment A.
5. Residuals Management Plan – Section 1.8 (Compliance Monitoring) – Please revise the metals
analysis frequency to correspond with the O&M Plan.
G. Summary for Form: RSC 06-16:
1. Currently, the table lists a Class A residuals production amount of 0 DT/yr between both the
existing facility (Hickory Regional Compost Facility) and the proposed facility (Henry Fork
WWTP). Please revise the Henry Fork WWTP’s proposed production based on the previous permit
issuance and historical data and revise sampling frequencies in the O&M Plan and Residuals
Management Plan (if necessary.)
