I have been traveling quite a bit for work lately but My wife, Angie, and I want to get this resolved ASAP. I am copying Michael Burkhard on the response because he has physically been to our house and laid eyes on the project himself. Maybe you two can discuss because you and Michael speak the same language when it comes to this kind of issue. I am trying my best to provide you exactly what you need. I have attached two drawings of the revised project and the survey. I have made some markups on each, please take a look at those. Notice on the survey they have drawn out the 50' and 30' buffer lines and each line on that survey represents 1' to give you an idea of the elevations at each buffer with the patio drawn in there. Again, Michael has seen my backyard and he can advise you on the topography of what we are dealing with. Total square footage of the patio fireplace is 725 sq feet which I listed below. 95 sq feet of this resides inside the 30' buffer line. The entire patio is inside the 50' so that would equate to the additional 630 sq feet. The square footage of the landing area to the patio is included in this 630 sq foot located outside the 30'. The stepping stones are 3'x1.5' which equals 4.5 sq feet each. There will be approximately 10 of these in the 30' zone leading down to the dock from the patio. This is approximately 45 sq feet total. Note, we are not stacking them, and they will have some spacing (reference plan). As I noted, the photos I sent are not my project nor will my steps be laid out like that. We plan to leave spacing between each stepping stone to allow for permeability, which we discussed with Michael Burkhard when he was out the last time. He said that would work. The photo only represents the type of stepping stone/material make-up we will be using. Note on the revised plan, the stone drainage swell will stop at the 50' buffer even though it is not to exact scale on the drawing. There is no physical survey of the repair area but the septic system was permitted and signed off on by Catawba County when the house was built in 2021. We did not build the house, my late mother-in-law did. I hope and pray this answers your requests. PLEASE reach out to Michael Burkhard for any additional clarity. I need you to submit a diagram or photo showing how you plan to lay these stones to allow for permeability. I'm not sure who's how this is in the photo but they are not in compliance from what I can see. The first thing I had requested was for your surveyor to show Zone 1 30' and Zone 2 20'. Again, this is a total of 50' from the 760' contour line. However, you need to show them both on your plan. I only see the 50' buffer, I need to know where the first 30' (Zone 1) is. I also need the measurement of the patio that are in each zone. Because you have not provided the areas of the different Zones, I also don't know if your repair area is in Zone 1. Please see my original email with the questions below. Your project will remain ON HOLD until I have the correct information. It took me a little over a month to get a surveyor to come out the second time then time to put together the elevations on a file. I wish Michael Burkhart (Dept of Environmental Quality) who visited the site would have told me to gather these elevations from the surveyor and it would have saved time and money for another visit from the survey company. I have included the septic permit showing the septic repair area, unfortunately the plan doesn't show elevations or the actual distance from our house. You will also see the revised plan with the square footage listed for the patio and the walkway steps. We were told by Michael Burkhart we had to space out the stone steps so it would be permeable, so that is the plan. We also plan to stop the stone swale at the 50' buffer mark and allow to dissipate into native grasses. The photos attached are examples of what the 3'x1.5' natural stone steps will look like, but this is not our layout obviously. The plan is to use mulch to stabilize the area until native vegetation takes root. We were advised to do this by Michael Burkhart with DEQ. Patio / fireplace Sq Footage = 725 sq feet Stone Steps are 4.5 sq ft each x 18 = 81 sq feet Please note all dock and sitting area by the water are pre-existing from the mid-1990s and no change there. As far as an explanation as to why they couldn't locate the patio closer to the house is due to the septic repair area. Unfortunately, at this point of the build process the patio is almost complete and would not really be feasible to alter the design/construction. This is where our contractor should have known in my opinion but there again, we hired them to do the job. It does look very nice what they did. Legible map with more details. You will need to provide the survey of the land including the 760' contour, Zone 1 (30') and Zone 2 ( 50') buffers. Please provide these on your map that includes the fireplace/patio and the restoration plan. 2. Please provide all measurements of your patio (sqft in Zone 1, sqft in Zone 2, total sqft). Please also include the sqft of the steps/walkway that is shown on your drawing. Are those preexisting and approved or are you asking to have those approved as well? What material are they made from? 3. 1 will need the sqft of the dock if any is located above the 760'. 4. Please show on your map where the septic field is and dimensions. 5. Explanation of why the patio/fireplace could not be put in the "lawn area" or the area closer to the house that would be outside of Zone 1 and possibly Zone 2. According to the map you provided there seems to be a large area where a patio could be placed that would not impact the buffer or would minimally impact the buffer. 6. Explanation of why the included plan cannot be practically accomplished, reduced, relocated, or reconfigured to avoid or better minimize disturbance to the riparian buffer, preserve aquatic life and habitat, and protect water quality. 7. Plans for any best management practices proposed to be used to control the impacts associated with the activity. 8. Sgft of the stone swell that is in the riparian buffer. Does this stone swell already exist or are you requested this in your application? Please review the Catawba River Basin Buffer 15A NCAC 02B .0614 regarding stormwater runoff through the riparian buffer. I7 (8) STORMWATER RUNOFF THROUGH THE RIPARIAN BUFFER. Stormwater runoff into the riparian buffer shall meet dispersed flow as defined in 15A NCAC 02H .I002 except as otherwise described in this Item.
