Please see the below responses to the January 12, 2024, Notice of Violation Letter
• Storm Water Pollution Prevention Plan (SWPPP) has not been properly implemented
o XPO is reviewing and amending the facility's SWPPP as needed.
o XPO to conduct and record monitoring per the conditions of the permit.
• Qualitative Monitoring has not been conducted and/or recorded in accordance with permit
requirements
o XPO-NLB facility will complete storm water visual monitoring quarterly,to be completed
by 3/31/2024.
• Analytical monitoring has not been conducted and/or recorded in accordance with permit
requirements
o XPO has contracted a third party to assist with storm water monitoring to be completed
by 6/30/2024 and reported in the eDMR system.
• Provide a description of the conditions which led to lack of eDMR submission for the first
monitoring period of 2023.
o Lack of DMR submission for the first monitoring period of 2023 was due to lack of
signatory authority.
o XPO has submitted all documents to change facility name,facility ownership, and
ownership contact information to register for eDMR.
• Was a corrective action plan (CAP)ever submitted to the Department for the elevated TSS
concentrations reported for Outfall 001 in 2019?
o No. XPO was under previous management in 2019 and there are no records of a CAP
submittal. Please advise on how XPO can correct this issue.
