Director Haley Beaty, Mayor Town of Dallas 210 N Holland St Dallas, NC 28034-2749 NORTH CAROLINA Environmental Quality May 21, 2024 SUBJECT: NOTICE OF VIOLATION / NOTICE OF INTENT TO ENFORCE Tracking Number: NOV-2024-PC-0305 Permit No. NCO082694 Dallas WTP Gaston County Dear Ms. Beaty: The North Carolina Division of Water Resources conducted an inspection of the Dallas WTP on May 3, 2024. This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES WW Permit No. NC0082694. A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the inspection report. The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Mooresville Regional Office. The following violation(s) were noted during the inspection: Inspection Area Description of Violation Facility Site Review Reporting Requirements Operations & Maintenance The wastewater level in the treatment lagoon is over the top of its holding capacity. There is water overtopping the berm adjacent to the walkway across from the drying beds. The drying beds have standing water and sludge in place. By visual observation, it appears the drying beds are not draining fluid and may require reconditioning in order to allow flow to the underdrains of the drying beds. Suite 301 1 Mooresville, North Carolina 28115 704.663.1699 In addition, the issues below must also be addressed: Compliance Issue(s): Section III OPERATIONS AND MAINTENANCE REQUIREMENTS: 1. The Permittee shall at al/ times properly operate and maintain properly maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the Permittee to achieve compliance with the conditions of this permit. Proper operation and maintenance a/so include adequate laboratory controls and appropriate quality assurance procedures This provision requires the Permittee to install and operate backu or auxiliary faci/ides only when necessary to achieve compliance with the conditions of the permit 40 CFR 122.41 (e)J. Section IV MONITORING AND REPORTING REQUIREMENTS: 8. Noncompliance Notification The permittee shall report by telephone to the Mooresville Regional Office, telephone number 704-663-1699, as soon as possible, but /n no case more than 24 hours or on the next working day the fo/%wing occurrence or the first knowledge of the occurrence of any of the following. (d) Any process unit failure, due to know or unknown reasons, rendering the facility incapable of adequate residual treatment. [15A NCAC 02T .111(a)]. These same issues were noted in under NOV-2022-PC-0041 in April 2022, but they have been allowed to occur again. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. A Notice of Violation and Notice of Recommendation for Enforcement, pursuant to G.S. 143-215.6A, may result in a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per day, per violation and may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. You are requested to respond to this Notice in writing within thirty (30) days of receipt indicating your Plan of Action to ensure future compliance.
