Per our conversation, during a recent joint compliance inspection with NCDENR Land and Water
Quality Sections, a potential scour problem was identified at Site 8 adjacent to station 325+00
left. There is an extensive piping system running through this S curve and there is concern that
downstream bed and bank scour may be accelerated by water discharging from this pipe.
In order to address this issue, all parties agreed to install a stone energy dissipater pad from the
outlet of this pipe to our right-of--way line for a total distance of about 35 linear feet. Stream
slope will prohibit the creation of a plunge pool. Ideally, we would like to excavate and begin
placing the stone about 2 feet below the streambed grade. However, bedrock is present in several
locations under the streambed so the stone will be placed as deep as the excavation allows. We
will use a combination of clean stone ranging in size from class II to class B.
The proposed modified impacts are minor in nature and should improve downstream water
quality. Increasing the streambed roughness and braiding the channel through the dissipater pad
should reduce water velocity, thus lowering the potential for bed and bank scour downstream. I
have attached a plan sheet and topography map for your review.

Resources Commission comment directly to you concerning the 404 Permit modification with a
copy sent to me.

By copy of this letter, it is requested that the NCDENR, Division of Water Quality modify the
401 Water Quality Certification to reflect this plan change. It is also requested that any comments
related to the 401 certification be forwarded directly to me with a copy sent to the US Army
Corps of Engineers. Based on our telephone conversation, it was noted that no additional
mitigation would be required.
If further information is needed, please let me know. Your early review and consideration will be
appreciated.
