Ellison WTP Cleveland County Dear Mr. Wells: Dee Freeman Secretary Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The Division has reviewed your correspondence of July 28, 2008. We apologize for the considerable amount of time that has passed since you submitted your comments to the draft permit. Based upon those comments and reevaluations of data from the facility, this final permit includes the following changes from the draft permit sent to you on June 18, 2008: • The flow mdasurement method has been changed from continuous t0 an estimate due to the intermittent nature of the discharge. However, if it is determined that using the filter backwash rate is not a reliable estimate of actual flow to the receiving stream, the Division may require the facility to implement a method capable of providing an accurate effluent flow measurement. Additionally, the limit for flow has been removed from the permit. • The monitoring requirement for whole effluent chronic toxicity has been retained from at a 0.89% concentration. This concentration is based upon the estimated release of water from the reservoir upstream of the outfall. The Division is unable to act upon your request to remove this monitoring requirement; it part of the Division's permitting statewide strategy for discharges from conventional water treatment plants. -Please be aware that at the present, this is simply a monitoring requirement, with no associated compliance limit. This monitoring requirement may be modified -upon the next permit renewal, depending upon the results of testing conducted during this permit cycle. • Monitoring for Total Iron has been removed from the permit based upon a reasonable potential analysis (RPA) of data from the facility. Wells NC0079740 Permit Renewal p 2 The monitoring frequency for aluminum has been reduced to quarterly monitoring based upon a reasonable potential analysis (RPA) of data from the facility. While the RPA indicated the facility discharges aluminum in such concentrations that the water quality standard for this parameter should be protected in the receiving stream, effluent values for aluminum are much higher than seen in most conventional WTP discharges. The facility should examine its operations to determine if changes can be made to reduce the discharge of aluminum into Buffalo Creek. Depending upon the results of continued monitoring and toxicity testing, a limit may need to be imposed for this parameter. • Because Buffalo Creek has been deemed impaired for turbidity, monitoring for turbidity has been retained as found in the previous permit, as an upstream and downstream monitoring requirement. Discharges from the facility should not raise turbidity levels above the 50 NTU water quality standard, or raise the turbidity of the receiving stream if background levels are above 50 NTU. Buffalo Creek is listed as an impaired stream on North Carolina's 303(d) list. This means that the stream does not meet all water quality standards. Although non -point sources are believed to be the main contributors to this degradation, the Division will continue to monitor discharges from your facility. Should any additional degradation of the stream be attributable to the discharge, the Division will take necessary steps, including modification of the permit, to ensure protection of surface water quality. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. The pH shall not be less than 6.0 standard units, nor greater than 9.0 standard units. 5. Monitoring should be performed in conjunction with toxicity testing.. 6. Ceriodaphnia dubia 7day pass/fail test in January, April, July and October. See Condition A. (2.) for toxicity testing requirements. Toxicity sampling should coincide with sampling for parameters covered by footnote 5. All samples collected should be of a representative discharge. (2.%CRONIC TOXICITY - MONITORING ONLY (QUARTERLY) The permitte hall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina Cerio aphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions. The effluent concen -ation defined as treatment two in the procedure document is 0.89 %. The testing shall be performed as Ceriodaphnia dabia 7day pass/fail test. The tests will be performed during the months of January, Ap , July and October. Total residual chlorine of the effluent toxicity sample must be asured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility uring a month in which toxicity monitoring is required, the permittee will complete the information to med at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe nu ber, county, and the month/year of the report with the notation of "No Flow" in'the comment area f the form. The report shall be submitted to the Environmental Sciences Section at the address cited a ve. Should the permittee fail to monitor during a month in which to city monitoring is required, then monthly monitoring will begin immediately. Upon submission of valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performe by the North Carolina Division of Water Quality indicate potential impacts to the receiving strea , this permit maybe re- opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this pe it, the results of such monitoring shall be included in the calculation & reporting of the data submitted the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as mi 'mum control organism survival, minimum control organism reproduction, and appropriate environment controls, shall constitute an invalid test and will require immediate follow-up testing to be completed n later than the last day of the month following the month of the initial monitoring. My name is Bob Sledge, and I work in a compliance and permitting unit within the Division of Water Quality. I sent the City a draft version of a NPDES permit renewal for the City's water treatment plant in June 2008. You responded for the City in a July 25, 2008 letter, asking for modifications to the proposed terms within the permit. I initially looked into your requests, but promptly dropped the ball on this project. This e-mail is part of my efforts to get this matter moving forward again. Since the draft was originally prepared, a good deal of time has passed and the Division has re-evaluated its WTP permitting guidance. With the passage of time, the WTP also has submitted more data for particular parameters that has made a difference as to how the permit should look. These changes have led to the development of a final permit for the facility. A copy of the proposed final permit and the accompanying cover letter are attached. It is my intention to have the permit issued this week, and I do not believe there is room for any modification of its terms, but I did want you to be able to see it before it is sent out. One matter I need to discuss with you is with regard to turbidity monitoring in the permit. Originally, this parameter was removed in the 2008 draft permit. However, due to EPA's prompting, some form of turbidity monitoring must be placed in WTP permits. Those facilities discharging to streams that are impaired for turbidity must receive a limit, but permittees are being given an option. The Ellison WTP does discharge into an impaired stream. You may choose to continue to monitor turbidity in the stream with a compliance judgment based upon whether or not the 50 NTU stream standard is exceeded in the downstream sample, or you may monitor the effluent for turbidity and be given a 50 NTU effluent limit. I took the liberty of placing the up and downstream option in the attached permit, but please let me know if that is what the City would like to do. Other changes are noted in the attached cover letter. Most should be seen as to the City's advantage when compared to the terms of the 2008 draft. Although the cover letter on the draft was dated June 18, 2008, we just received it July 16, 2008. After noticing the cover letter date we tried to contact you July 24, 2008, and was informed by Ms Karen Russ that you were out of the office until Monday July 28, 2008. Ms. Russ informed us to submit our response to you as soon as possible. We would like for you to take into consideration that this facility has been rated as a Class I (one), and is not considered as Biological Treatment. First of all, we have no way of monitoring our discharge other then estimating it according to the filter backwash rate. The discharge to the creek is a batch flow, and not a continuous flow. We would like for you to consider leaving our sample type for flow as estimate. Second of all, we would strongly like for you to consider waving the Whole Effluent Toxicity monitoring. According to our Effluent concentration of 0.89% we find it hard to believe that this discharge would/could have a toxic impact on the stream. Once again this is only filter backwash water not wastewater. Third of all, according to the Effluent Limitations and Monitoring Requirements Footnotes (3) we would like to request a wavier for Calcium, Magnesium and Manganese. Also, we would like for you to review the previous data submitted on Iron and Aluminum, and if possible consider our request to waive those parameters. The Historical City Last but not least, we would like for you to consider changing the monitoring frequency for Copper and Fluoride from Monthly to Quarterly.
