Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on August 15, 2003. This permit includes a TRC limit that will take effect on May 1, 2005. If you wish to install dechlorinadon equipment, the Division has promulgated a simplified approval process for such projects. Guidance for approval of dechlorination projects is attached. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Ellison Water Treatment Plant Page Two The facility was last inspected by Linda Love of this Office on February 23; 2000. PERMIT: The water treatment facility is permitted to operate a sludge settling basin and two sludge drying beds and discharge from Outfall 001. The permit adequately describes the treatment facility. The permit became effective on 1 /1 /99 and expires on 8/31 /03 . RECORDS AND REPORTS: Records and reports consisting of discharge monitoring reports (DMR's), chain of custody forms, calibration logs, Operator -in -Responsible Charge (ORC) sign -in log, sludge records, and lab analyses reports were reviewed at the time of the inspection. The records were accessible and organized. FACILITY SITE REVIEW/OPERATIONS & MAINTENANCE: The settling basin appeared to be operating properly and well maintained. The surrounding grounds were well maintained. An additional settling basin is utilized as an overflow basin. The water is pumped back into the main settling basin via portable pumps. The facility is staffed with a Grade III ORC. A designated certified back-up operator is available when the ORC is unable to visit the facility. LABORATORY: The City of Kings Mountain Pilot Creek WWTP Laboratory (Certification 4222) and the contracted services of Par Laboratories, Inc. (Certification 420) in Charlotte, N.C. provide analytical support. The laboratories were not evaluated at the time of the inspection. The Pilot Creek WWTP Laboratory does not charge a fee for the analyses conducted for this facility. A laboratory exemption request to perform the on -site parameters for pH, total residual chlorine, and settleable solids was granted by the Division's Laboratory Certification Unit on 11/5/97. EFFLUENT/RECEIVING WATERS: The facility is permitted to discharge effluent into Buffalo Creek, which is a Class C water in the Broad River Basin. At the time of the inspection, the facility was not discharging and the receiving stream was not evaluated. The outfall was well maintained and accessible. SELF -MONITORING PROGRAM: Self -monitoring reports were reviewed for the period September 1999 through June 2000, inclusive. No limit violations were reported. All monitoring frequencies are correct. The upstream and downstream locations are consistent with permit requirements. FLOW MEASUREMENT: The flow is measured by multiplying the pump hours by the pump rate from a single non - variable rate pump located at the backwash filter. SLUDGE DISPOSAL: Solids from this facility is dried on two sludge drying beds and then transported by the water plant personnel to the Gaston County Landfill for final disposal. A drain is located at the unloading area of the sludge drying beds that is connected to the settling basin.
