On April 25, 2024, staff of the NC Division of Water Resources (DWR), Water Quality Regional
Operations Section (WQROS) inspected Billy Bordeaux Farm waste disposal system. We wish
to thank Mr. Bordeaux, who was present and assisted during the inspection.
As a result of this incident, you are hereby notified that, having been permitted to have a non -
discharge permit for the subject animal waste disposal system pursuant to North Carolina
General Statutes G.S. 143-215 et seq. Section .402, you have been found to have been found to
be deficient of your permit as follows:
Deficiency 1: Failure to have a current waste sample:
An analysis of a representative sample of the animal waste to be applied shall be conducted in
accordance with recommended laboratory sampling procedures as close to the time of
application as practical and at least within sixty (60) days (before or after) of the date of
application. Every reasonable effort shall be made to have the waste analyzed prior to the date
of application and as close to the time of waste application as possible. This analysis shall
include the following parameters:

On April 25, 2024, during your routine inspection, it was determined that you had only one
waste sample in 2023, 2022, 2021 and there was no current waste sample for this year. This has
been an issue for the last couple of years. The waste sample needs to be taken 60 days before or
within 60 days after a pumping event. Your IRR records show out of compliance for the last
couple of years. It was discussed last year that you need a waste sample at least every quarter and
that would cover you for the year.
Required Corrective Action for Deficiency 1:
You need a current waste to cover 60 days before or 60 days after a pumping event. If the
samples were taken every quarter, you would be covered.
The Division of Water Resources requests that, in addition to the specified corrective action
above, please submit the following items on or before 30 days from receipt of this letter:
1. You need to get waste samples to cover your pumping events at least one every quarter to cover
60 before and 60 days after.
2. A explanation from OIC why this occurred.
3. A list from the OIC concerning the steps that will be taken to prevent these violations from
occurring in the future.
Failure to comply with conditions in the permit may result in a recommendation of enforcement
action, to the Director of the Division of Water Resources who may issue a civil penalty
assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who.
violates or fails to act in accordance with terms, conditions, or requirements of a permit under
authority of G.S. 143-215.6A
