PROJECT SUMMARY: The proposed development is for a bulkhead, boat ramp, dredging, and coastal and 404 wetland fill. 9. NARRATIVE DESCRIPTION: Phillip Wynn's project is located at 113 Bimini Court, Craven County in Havelock, NC. The parcel is 2.07-acres and is located off of Clubfoot Creek. Clubfoot Creek is a tributary to the Neuse River. The waters of Clubfoot Creek are classified as SA, HQW, and NSW. The area is closed to shellfish harvesting. The average depth in the proposed boat ramp location is -1.5' at NWL. From land to the edge of the dredge area water depths were-3.5'NWL (connecting waters depth) on May 6 during site visit. The project site is 220' and clubfoot creek is 844' wide at its narrowest point along this shoreline. No shellfish was observed within the location of the project area. During a site visit on May 6 water clarity was roughly 2-2.5' feet and the presence of SAV was not observed, however neighbors to the south have supplied objections with pictures of possible SAV within the area. Both section 404 and coastal wetlands (Bulrushes, Black Needlerush, and Giant Cordgrass) are present. Based on survey there is 5,011 square feet of coastal wetlands and 968 square feet of non -coastal wetlands. The project site is unzoned by Craven County. Two lots were combined (Lots 8 and 9) consisting of 2.07 acres. Onsite there is grass, trees, shrubs, landscaping, driveway, house, retaining wall, riprap for wetland protection (waterward of coastal wetlands) and pier with platform. 10. PROJECT DESCRIPTION: The proposed project is for a bulkhead, boat ramp, dredging, and coastal and non -coastal wetland fill. The applicant is proposing to construct a 10' wide by 41' long concrete boat ramp (15' being waterward of NWL) as well as a 14'x14' access pad in order to provide boating and water access for the existing 32 lot subdivision. They are also proposing 2' of rock that would be placed on either side of the boat ramp. The proposed riprap would act as wave attenuation, help harden the shoreline and protect the ramp. The proposed boat ramp would be located 15' from the property line to the south. The placement, per the applicant, would help reduce the amount of wetland impacts as requested in the scoping meetings. The applicant is also proposing new excavation for an access channel waterward of the proposed boat ramp. The proposed access channel would measure 74' long and 30' at the widest point as proposed. The average existing depth is -1.5' NWL and the proposed new excavation final depth would be 3.5' NWL to the connecting water depth (3.5' + NLW). The connecting depth was confirmed during a May 6, 2024 site visit. The dredge spoil would be placed on high ground for dewatering prior to using as backfill for the proposed bulkhead/retaining wall. The applicant is also proposing a 336' long bulkhead/retaining wall with a 1' wide cap. In order Field Investigation Report: Phillip Wynn DCM Major Permit Page 13 to help stabilize the shoreline on both sides of the proposed boat ramp, they are proposing a 6' section of bulkhead north of the ramp, a 16' section south of the ramp with 15' tiebacks along, and a 146' section of retaining wall on the southern border of the property. The remaining 138' of bulkhead/retaining wall would be installed on high ground and would connect to the existing bulkhead/retaining wall along the northern portion of the property. Fill material from both the dredge spoils and off -site upland area would be used to backfill landward of the bulkheads/retaining walls and the necessary grading would be done to cover parts of the existing wall and match the existing grade as much as possible. The total upland area to be filled is 9,500 square feet with approximately 384 square feet of coastal wetland impacts, and 360 square feet of non -coastal wetlands impacted. The final portion of the project would be the removal of 10' of the existing riprap to allow for fish and other aquatic invertebrates and vertebrates passage. The 10' of rock removed would be utilized along the existing riprap footprint. 11. ANTICIPATED IMPACTS: The proposed bulkhead/retaining wall and boat ramp would have impacts to coastal (384 square feet) and non -coastal wetlands (360 square feet) by filling them. The boat ramp would create impervious area (above NHW) within the Neuse River buffer and CAMA AEC's. The proposed new excavation for the access channel would impact 1,870 square feet of bottom within Clubfoot Creek. No SAV were observed during the site visit on May 6, 2024. As previously mentioned, the neighbors have objections with pictures of what they believe are SAV in the area. The waters of clubfoot creek are listed as a Secondary Nursery Area and are classified as SA, HQW, and NSW. The property and waters are located within the Neuse River basin and are closed to shellfish. No hazard to navigation should occur due to the fact the proposed work is at or landward of the existing piers along the shoreline. The project site has a Havelock mailing address but is located within an unincorporated area of Craven County, Mr. Wynn's property consists of Lots 8 and 9 of The Moorings Subdivision Section 1. Existing development at the site includes his permanent residence with driveway, a bulkhead/retaining wall, riprap along a section of the shoreline, and a pier with a platform. The owner acquired Lot 9 in 1999 for construction of his residence and dock. Prior to construction of the residence, it was necessary to elevate the lot sufficiently to construct the house. The existing retaining wall was constructed to contain the original fill and support the foundation of the residence. The existing retaining wall is deteriorating and needs substantial repairs or replacement. In 2021 Mr. Wynn acquired Lot 8 and recombined the two lots to allow for construction of a boat ramp and other improvements. Mr. Wynn's currently proposed project is comprised of the following components: • excavation and construction of a concrete boat ramp and access channel • construction of an additional bulkhead/retaining wall to connect to the existing retaining wall • placement of highground fill material and associated grading to cover and match the grade of the existing bulkhead/retaining wall as much as possible • relocation of a portion of existing riprap along the shoreline The proposed boat ramp will be built on private property with private funds by Mr. Wynn. It will provide water and boating access for members of the 32-lot Moorings community. There are currently 16 residential docks along the shoreline, with 22 boat slips in the existing Wynn Bulkhead and Boat Ramp Project Phillip Wynn Major CAMA Permit Application April 22, 2024 Page 1 Moorings residential marina. Typical boats using the ramp will be open 25' runabouts and personal watercraft. One of two existing public boat ramps nearest the Moorings is located at Cahooque Creek, approximately 20 miles round trip by vehicle and further by boat. The other boat ramp is located within the Sea Gate community and is approximately 40 miles round trip by vehicle and much further by boat. Having access to a nearby boat ramp will provide a public service to the community by providing a more convenient location to launch and retrieve boats or remove them from the water when boat maintenance is required. The proposed ramp will also facilitate removal of boats from the waterway when hurricanes and other storms are approaching the area, as the existing boat ramp facilities are typically overcrowded during these times. No onsite parking area for users of the boat ramp or additional impervious surfaces other than the boatramp are proposed. Once boats are launched or retrieved, owners will be expected to immediately relocate vehicles and trailers to their personal property. Site Description Clubfoot Creek is a tributary of the Neuse River, with waters classified by the NC Division of Water Resources as SA-HQW, NSW. The area is also designated as Prohibited for shellfish harvesting by the NC Division of Marine Fisheries, Shellfish Sanitation and Recreational Water Quality Section. Average existing water depths in the proposed boat ramp location measure - 1.5' Normal Low Water (NLW). The shoreline of the project site measured along Normal High Water is 220 linear feet. Clubfoot Creek is 844' wide at its narrowest point along this shoreline. The area to be disturbed by the project contains no shell bottom. Resource agencies have indicated that there is no historical data of the existence of submerged aquatic vegetation (SAV). Section 404 and coastal wetlands are present at the project site and have been delineated by Headwater Environmental, Inc. and surveyed by James Phillips, PLS as shown on the map of existing conditions. Based on the survey, the project site contains 5,011 square feet of coastal wetlands and 968 square feet of non -coastal wetlands. Copies of the Headwater Environmental Inc. maps and figures are included with this CAMA permit application. The project site is unzoned by Craven County. The recombined lot (Lots 8 and 9) consists of approximately two acres. Vegetation on the parcel consists of grass, landscape vegetation, and coastal and non -coastal wetlands. As previously noted, existing man-made structures include a Wynn Bulkhead and Boat Ramp Project Phillip Wynn Major CAMA Permit Application April 22, 2024 Page 2 single-family residence with driveway, riprap, a bulkhead/retaining wall, and a pier with platform. An existing individual septic system provides wastewater treatment for the Wynn property. Adjacent riparian property owners to the south are Steven P. and Lisa L. McCracken. The adjacent riparian parcel to the north is owned by Duane and Dorothy E. Usa. Project Description Project plans place the bulkhead/retaining wall and boat ramp where the least impact to wetlands will occur. The proposed concrete boat ramp is 10' wide and 41' long and includes a 14' x 14' access pad as shown on project plans. To stabilize the ramp and dissipate wave energy, 2' of rock will be placed on both sides of the boat ramp. An access channel measuring 74' long and 30' at the widest point is also proposed. The average existing depth of the boat ramp is -1.5' NLW, with a final project depth of -3.5' NLW to be maintained from the bottom of the ramp through the dredged area. Dredge spoils from the excavation will be placed onsite on high ground for dewatering prior to being used as backfill for the proposed bulkhead/retaining wall. The boat ramp will be located 15' from the adjacent riparian corridor to the south. This location will limit the area of wetlands impacted by the work. The project team pursued moving the boat ramp slightly south into the CAMA riparian corridor setback. However, the Moorings subdivision covenants require a minimum 10' setback from the side property line for any structure. Also, in the absence of a waiver from the adjacent riparian property owner, CAMA regulations require the ramp to meet a 15' setback from the riparian corridor. A new proposed vinyl sheetpile bulkhead/retaining wall, measuring a total of 336' in length, with a 1' wide top is also proposed as part of this project. To stabilize the shoreline on both sides of the boatramp, a 6' section of bulkhead north of the ramp and a 16' section south of the ramp are included, both with 15' tiebacks as shown on project plans. A section of retaining wall measuring 146' is proposed for placement along the southern border of the Wynn property where it adjoins the neighboring property. The remaining 138' of bulkhead/retaining wall will be installed on high ground and connect to the existing retaining wall. Fill material (both dredge spoils and material from an off -site upland area as needed) will be placed on the site and graded to cover the existing failing wall and match the existing grade as much as possible. The alignment of the proposed highground retaining wall is designed to minimize impacts by routing around wetlands on the site. The proposed total upland area to be filled measures approximately 9,500 square feet. Approximately 384 square feet of coastal wetland marsh and 360 square feet of non -coastal wetlands will be impacted by construction of the concrete pad and boat ramp and backfill for the retaining wall/bulkhead (see Bulkhead and Ramp Plan submitted with the permit application). Project plans also show the removal of 10' of existing riprap midway along the shoreline to allow for aquatic passage of fish. Removal and relocation of sections of existing riprap within the limits of the new ramp and bulkhead is also proposed. The rock to be removed will be reused along the shoreline. Neuse River Buffer Certification The project site is located within the Neuse River Basin. The project will require both 401 water quality and buffer certifications. Minimization (Measures To summarize, minimization measures implemented in the project design include the following: • Dredging to be maintained at a 3.5' depth from the bottom of the ramp through the dredged area, thus reducing any impacts to shellfish that may or may not be present in the area • 10' gap in the riprap midway of the section north of the ramp to allow for aquatic passage of fish • Location of the ramp at the least impactful location given location of wetlands and CAMA and subdivision setbacks • Alignment of the retaining wall routed around wetlands • Construction methods as described below minimize impacts Wynn Bulkhead and Boat Ramp Project Phillip Wynn Major CAMA Permit Application April 22, 2024 Page 4 Construction Methods A backhoe-type excavator mounted on a barge will be used for excavation of the access channel. Spoils from the access channel excavation will be loaded on a barge, hauled to shore, off-loaded into trucks, and then deposited in the low areas of the property. The boat ramp excavation will occur by backhoe from high ground, with spoils transported by truck and placed in low areas to be filled. Dredging spoils from the access channel excavation will be placed onsite on high ground for dewatering prior to being used as backfill for the proposed bulkhead/retaining wall. Typical excavation, pile driving, and grading equipment and practices will be used for construction of the bulkhead/retaining wall and grading of highground areas. Mechanical placement of a prefabricated boat ramp will occur in the boat ramp location as shown on project plans. There will be no live concrete in the water. Removal and relocation of existing riprap will occur by hand or excavator. No wetlands will be crossed in transporting equipment to the project site. 401 Pre -Filing Meeting Request A scoping meeting for this project occurred on March 8, 2022. Due to turnover on the project team as well as staff of the regulatory agencies, and the availability of additional information related to the site (survey, wetland delineation, water depths, and preliminary plans), a second scoping meeting was held on October 25, 2023.
