On December 14, 20I5, the Division of Water Resources (Division) received your application
dated December Il, 2015, requesting a Major Variance from the Division for the subject project.
The Division has determined that your application is incomplete and cannot be processed. The
application is on -hold until all of the following information is received:
l. You have indicated that you are making a payment to a local mitigation bank or in -lieu
fee program as your mitigation plan, p|eG52 provide documentation from an appropriate
mitigation bank or the Division Of Mitigation Services indicating their willingness to
accept your request to purchase buffer credit to mitigate for the proposed buffer impacts
listed inyour application.
A4OIWater Quality Certification will benecessary tOpipe the stream for the project
should the major v8ri8nCebe8pprOved. The project aspnJpOS2dvvouldev0id
approximately 20 linear feet of stream by constructing a retaining wall shaft around the
channel, which would be surrounded byimpervious area. The Division believes this
proposal would result in a degraded stream channel that does not support existing uses.
Therefore, when applying for 8 40I Water Quality Certification, the preserved stream
channel should be included aSanimpact along with aplan tOmitigate the impact.
In the StormwaterImpact Analysis & Preliminary Design of Stormwater Management
Facility, please add a note of explanation Or revise the placement of the Sand Filter
Summary section to minimize the opportunity for confusion on the Required
Sedimentation [honnberSur/o[eArea and Sand FilterSur/oceArea. |tappears tVindicate
