Henderson Couuty, North Carolin� WBS Element No. 17BP.14.R.44 Dear Ms. Beckwith: The North Carolina Department of Transpo��tation (NCDOT) is proposing to replace the subject bridge. This bridge is a sh�uctw�ally deficient 16.5' L s 20' W single span timber deck ou timber joist structure. The ne�v struchue will be a 2� 45' L s 1 I' W x 5.5' H reinforced concrete bos culvei�t on a I 15° skew and 1.89% slope. The bridge and culvert work �vill be staged to handle traffic on this dead end road during the construction. The culvert inve�t �vill be buried one foot below the stream bed. Also, tlte low flow cell will I�ave L' H inlet and outlet sills and a mid-cell baffle and the high flow cell will have 2' H inlet and outlet sills and floodplain benches. These features should maintain a low flow channel morphology, hold some bedload in tl�e culveit while also transporting inflowing sediment, and facilitate aquatic life passage through the crossing. The Noith Carolina N�tural Heritage Program lists 40 species with federal stahis for I Ienderson Couuty that are known from current records or were kno�vn to occur in the county historically. The bog turtle (Gly�ienrys nruhlenbergii) is listed as threatened due to similarity of appearance [o the northern bog uutle. Eight species, Carolina no�4hern flying squirrel (Glnucanys snbrnrais colornnrs), Appalachian elktoe mussel (A(nsmidonto rmenelinnn), swamp piuk (Helonias ballntn), small whorled pogonia (]soh•icr merleo(oides), bunched arro�vhead (Sngi�trn•in fasciculrrin), mountain sweet pitclter plant (Snrrnceni� jonesir), white irisette (Sis�n�incltiun� dicltotorntun), and no�rthern long-eared bat (NLEB, �lL��olrs sepleno•ionrdis) have current records and are listed as threatened or endangered. The Appalachiau elktoe mussel is found in well-osygenated, cool-water rivers with moderate to fast flowing water and stable, mised-subsh�tes of silt, sand, gravel, and/or cobble. Tlie Appalachian elktoe records in tlie region are from relatively large streams sucl� as the French Broad, Little, and Mills rivers. There ai� no records of occurreuce in tributaries to these rivers. Mud Creek is too polluted with sediment to support mussels. And, Peny Creek is too small to support mussels. The terrestrial l�abitat in the vicinity of the bridge has been dishu'bed by the roadway and its mainten�nce, a drive�vay, and manicured lawns ai�d landscaping. As is typical in much of suburban Henderson County, the riparian habitat on Peny Creek is mostly comprised of hu�f grasses �vitli scattered shrub and h ee cover. The bridge site is only about 2,120 feet in elevation, so there is no habitat present for the Carolina no�thern flying squirrel. White irisette habitat includes mid-elevation slopes with open d�y to mesic oak-hickoiy forest, typically on rocky steep terrain witli shallow soils. This plant has only been found in the eastern part of Henderson County. Tlie area near the bridge is landscaped and not suitable for white irisette. Swamp pink and motmtain sweet pitclier plants botli require saturated-soil wetlands, usu�lly bogs, while bunched arrowhead is considered a submerged aquatic plant tl�at is associated with low flow seepage areas. There are isolated wetlands in the Henderso��ville area within a few miles of the bridge that suppoit tliese plants. However, there are no �vetlands in or near the project area. Small whorled pogonia occin's in open, dry, deciduous woods with acid soil, though it can also occtu' on slopes along streams. It is also kno�vn to occur in rich, mesic forest in association with white piue and rhododendron. Habitat is Iacking for this plant because there are no woods near the bridge and the stream is not along a slope. NLEB are k�iown to roost in caves and mines in winter and, in summer, on h'ees with sloughing bark or on structures, includiug concrete bridges that retain heat. The esisting bridge is a low timber structure that should be too cool for bat roosting. During the field scoping and subsequent site visits we did not see any evidence ttiat bats were using the bridge for roosting (i.e. staining or guano). Also, there are no caves visible near the bridge and the nearest underground mine is over 9 miles away (USGS data). This project will require the removal of one large Nor�vay spruce and possibly a few large white pines, but iioue of the trees appear to be suitable for bat roosts. Tliere are no kno�vn NLEB hibernacula or maternij� roost trees with 0.25 mile or I50 feet, respectively, of the bridge site. Therefore, the project should be consistent witli esceptions for incideutal take outlined in the NLEB Pinal 4(d) rule which goes i�ito effect 2/16/l6. The project is limited in scope to the replacement of bridge with a culvert on an esisting roadway alignment Erosion and sedimentation control measures will be implemented to minimize adverse effects of the work on aquatic habitats. Habitats for listed species are lacking at the project site ancl none of these species were observed during tield visits. For these reasons and tltose discussed above, we recommend that a determination of "no effect" on listed species apply to this project (except for NLEB). This projecl �vas reviewed by NCDOT's Human Environment Unit in 2011 for potential effects to historical architechu�e and archaeology. Su�veys for architecture and archeological resources were conducted �vith conclusions of"uo resow•ces present/affected". If the devices are not functioning as intended, they will be replaced immediateiy �vith better functioning devices. Impncts to Waters of the United States Periy Creek (DWQ Class: B) is shown on the USGS topographic map as a perennial stream. The cliannel is well defined and approsimately 10' wide with a substrate of silt, sa�d, and cobble. Periy Creek at tlie bridge is about 2.1 miles upstream of Mud Creek, which then flo�vs about l0 miles to the Freiicli Broad River (HUC 06010 LOS). The French Broad River meets the defiuitio�i of a Traditional Navigable Water. For these reasons, we believe Peny Creek is a Relatively Permauent Water and is under thejurisdiction of the U.S. Army Corps of Engineers. Repincement of the bridge with a reinforced concrete bos culvert �vill result in impacts to waters of the United States as listed in the table below. Field investigations of the r1PE �vere comprised of a pedestrian survey nud subsurface testiug to locate and assess potentially significant archaeological remains that could be damaged or desfroyed by Ihe proposed briAge replacemenl project. The pedestrian survey and subsurface testing �vere conducted ou the allirvial tercaces adjacen[ to Bridge No. 3]4. Subsurface [esting in these alluvial settings was Tccomplished d�roiigh ihe placement of four (4) sl�ovel tests, one (I ) in Ihe S\V quadrant and tliree (3) in the NE quadrant, with a 30-m interval. Testing did not occur within the N\V nor ihe SE quadrants based on the presence of steeply sloped terrain, terraced house lots aud man-made hydrological I�ndscape fenlures (i.e. a pond with a ga�ed drivewny entrance). The subsurf�ce tests were placed along the outer RO\V for S2 I 141 (Hideaway Cove). The suspicious linear fe��ure delected on numerous aerials proved to be a ratl�er large garden plot (measuring abL 60 N. by 45 ft.) and does not con�elate wilh any supposed hisloric struclure or road [race. The garden area had recendy been tilled revealing no archaeologicnl materials, only rotten pota�oes and tometoes. Overall, no archaeological deposits �vere identified within the proposed APE. No nrchaeological sites �vere idenli(ied �vilhin the proposed APE, a��d no fiuther archaeological �vork is recommended prior to conslrucliou.
