4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:
Existing conditions consist of 2 parcels on the east and west side of Old Crews Road. The land is primarily wooded with some agriculture fields on the eastern parcel. Beaverdam Creek
and its FEMA floodplain/floodway bounds the northern portions of the property. There are four streams (Beaverdam Creek (J),M, R & A), sis wetlands (W1, W2, W3, W5, W6 & W7). The
pond and adjacent wetlands on the western property were determined to be non -jurisdictional. General land use in the vicinity consists of rural residential, wooded and agricultural land.

The overall project consists of 138 single-family detached homes and 150 townhome units totaling 288 units and the construction of roadway infrastructure, utilities, greenways, amenity
center and Stormwater Control Measures (SCM). Specifically, there are stream, riparian buffer and wetland impacts associated with a road crossing and a road widening, wetland, stream
and riparian buffer impacts associated greenways, wetland impacts associated with SCM construction, wetland, stream and riparian buffer impacts associated with utilities, and stream
impacts associated with lot fill. Equipment typically used for construction and earthwork such as backhoes, bulldozers, excavators, graders, pavers etc. will be utilized for this project.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: *
S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts
could be avoided & minimized to the maximum extent practicable. Impact Area A is a proposed boardwalk greenway crossing. Proposed impacts include
temporary stream impacts for construction, and riparian buffer impacts. This impact is necessary to provide a pedestrian connection to the eastern side
of the proposed development. Impacts have been minimized by proposing a boardwalk crossing over the stream and as such avoiding permanent
stream impacts. Impact Area B is proposed road crossing. Proposed impacts include permanent (i.e. culvert & headwalls), permanent -no permanent
loss (i.e. riprap dissipator pad) and temporary (i.e. construction access) stream impacts, permanent wetland and temporary impacts and associated
riparian buffer impacts. This road crossing is necessary to provide vehicular access to the eastern portion of the property. Stream, wetland and riparian
buffer impacts have been minimized by utilizing head walls and retaining walls at the crossing, and by designing the crossing at a near perpendicular
angle. Wetland mitigation is being proposed at a 2:1 ratio to compensate for these proposed permanent loss impacts. Impact Area C1 is proposed lot fill.
Proposed impacts include permanent stream loss. Per the project engineer, this impact is necessary for two reasons, 1) The SCM has been placed in
the lowest elevation in this portion of the site. This SCM footprint has been minimized as much as possible while still being able to service its required
impervious area. Relocating this SCM to an upland area away from the stream would reduce its ability to service the site and could therefore impact the
required stub road placement; and 2) The Town of Knightdale is requiring the developer to provide a road stub to the neighboring parcel to the west (PIN
1745948245). This connection is required because the parcel is landlocked and with no other access it would be undevelopable in the future. Due to
Knightdale's required street geometry, and the vertical fall in this location, this road grading would encroach in the stream. Impacts have been minimized
by utilizing a retaining wall. Impact Area C2 is proposed fill for SCM grading and a retaining wall. Proposed impacts include permanent wetland impacts.
Per the project engineer, the SCM has been placed in the lowest elevation in this portion of the site. This SCM footprint has been minimized as much as
possible while still being able to service its required impervious area. Relocating this SCM to an upland area away from the wetland would reduce its
ability to service the site. Wetland mitigation is being proposed at a 2:1 ratio to compensate for these proposed permanent loss impacts. Impact Area D1
is a proposed aerial sanitary sewer crossing. Proposed impacts include temporary stream impacts, permanent -no permanent loss wetland impacts and
associated riparian buffer impacts. This utility crossing is necessary to provide a connection to the regional pump station within the northwestern corner
of the property. Impacts have been minimized by utilizing an aerial sanitary sewer crossing vs. open cut. Impact Area D2 is proposed fill for SCM
grading. Proposed impacts include permanent wetland impacts. Per the project engineer, the SCM has been placed in the lowest elevation in this portion
of the site. This impact has been minimized as much as possible; however, the grading cannot change in this area as it is part of the SCM dam. This
dam has been graded to meet the minimum requirements and cannot be made steeper to reduce the impact further. The SCM footprint cannot be
extended to the west due to a sewer easement. The City of Raleigh will not allow SCM grading to be within a sewer easement. We cannot extend the
footprint to the east because the required access easement slopes would become too steep. The SCM footprint cannot be shifted to the north due to the
design of the retaining wall and the storm easements. Shifting this wall would then put the geogrid from the walls within the stormwater easement which
is not permitted. Wetland mitigation is being proposed at a 2:1 ratio to compensate for these proposed permanent loss impacts. Impact Area E1 is a
proposed sanitary sewer crossing. Proposed impacts include riparian buffer impacts. This utility crossing is necessary to provide sanitary sewer to the
eastern portion of the property and to connect to a regional pump station on the west side of Old Crews Road. Impacts have been minimized by shifting
the utility easement south to the maximum extent practicable and by utilizing the same easement as the proposed greenway. Zone 2 buffer impacts are
deemed allowable. Impact Area E2 is a proposed greenway crossing. Proposed impacts include riparian buffer impacts. This impact is necessary to
provide pedestrian access to the eastern side of the proposed development. Impacts have been minimized by shifting the greenway easement south to
the maximum extent practicable and by utilizing the same easement as the proposed sanitary sewer. Impact Area F is a proposed greenway crossing.
Proposed impacts include permanent wetland impacts. This impact is necessary to provide pedestrian access to the western side of the proposed
development. Impacts have been minimized by shifting the greenway easement south to the maximum extent practicable. Wetland mitigation is being
proposed at a 2:1 ratio to compensate for these proposed permanent loss impacts. Impact Area G is proposed road widening of Old Crews Road.
Proposed impacts include permanent (i.e. culvert extension and headwalls) and temporary (i.e. construction access) stream, permanent and temporary
wetland, and associated riparian buffer impacts. This impact is being required by the Town of Knightdale and NCDOT, per the TIA (Transportation Impact
Analysis). Impacts have been minimized by utilizing headwalls and retaining walls. Wetland mitigation is being proposed at a 2:1 ratio to compensate for
these proposed permanent loss impacts. Impact Area H is a proposed sanitary sewer crossing. Proposed impacts include riparian buffer impacts. This
utility crossing is necessary to provide sanitary sewer to the eastern portion of the property and to connect to a regional pump station on the west side of
Old Crews Road. Impacts have been minimized by shifting the utility easement south to the maximum extent practicable and by utilizing the same
easement as the proposed greenway. Zone 2 buffer impacts are deemed allowable.

Per the project engineer, the following measures will be utilized; silt fence, silt fence outlets, coffer dams,
temporary diversion channel, rip rap dissipator pads and filter bag for dewatering.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and
silvicultural operations. The Brio project is a residential development. Additionally, the project is located within the Town of Knightdale jurisdiction,
therefore the adjacent properties that have potential for development will have the fallowing regulations to protect downstream waters: 1) the Neuse
River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition Best
Management Practices may be required that control nitrogen if diffuse flow cannot be achieved, and 2) the Phase II NPDES Stormwater Permit
Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction
stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed.

This is a residential project and will produce non -discharge wastewater, which will be connected to the City of Raleigh sanitary sewer infrastructure. Per
project engineer, the Neuse River Resource Recovery Facility (formerly Neuse River Wastewater Treatment Plant) treats 50 million gallons per day, has
a maximum capacity of 75 millions gallons per day, and treats over 18 billion gallons per year.

S&EC completed a Threatened & Endangered Species Report, to include a Self -Certification letter through the US Fish & Wildlife Service (USFWS), a
query through the NC Natural Heritage Program database, and an official Species List through the iPAC. A formal request was sent to the USFWS on
October 2, 2023. The S&EC determinations were that the proposed project is not likely to adversely affect any federally -listed endangered or threatened
species, their formally designated critical habitat, or species currently proposed for listing under the Endangered Species Act (ESA). Please see
attached S&EC Threatened & Endangered Species report. S&EC has not received a response from USFWS.
