Good morning Taylor,
After internal review and discussions with WRC, the Corps has determined that this design for the above reference
project does not meet the terms and conditions of the Nationwide Permit. More specifically, the proposed piped culvert
installations would not allow for aquatic life passage as outlined in general condition 2 and regional condition 9 of the
Nationwide Permits. The multitude of 90-degree angles would prevent any type of aquatic passage between reaches.
Further, your permit application provided very little avoidance and minimization. Please provide a detailed explanation
as to why units 1-5 cannot be eliminated to facilitate either use of the existing culvert or installation of a typical culvert.
Please also provide an explanation as to why the existing —40OLF culvert cannot be daylighted and why the proposed
SCM cannot be designed in a manner to allow for aquatic life passage in this reach.
