2023 Residuals Annual Report Review

Dear Mr. Blankenship:
On April 16, 2024, Division of Water Resources staff Caitlin Williams completed a review
of the 2023 residuals annual report for the permit named above. This review reflected
noncompliance with the subject permit. The following violations were noted:
1. Per Permit Condition 11.3 only residuals generated by facilities listed in
Attachment A are approved for distribution, and Attachment A lists the maximum
permitted dry tons for each facility. A reported total of 2,246 dry tons were
distributed for Wade G. Brown WTP. The most recent Attachment A was issued
on November 15, 2022 and listed the maximum permitted dry tons for Wade G.
Brown WTP as 1,500 dry tons. The permitted dry tons were exceeded in July 2023.
This constitutes a violation of the subject permit.
The cover letter included in the annual report states a permit modification
application will be submitted to increase the permitted dry tons for Wade G. Brown
WTP to prevent future instances of non-compliance. Submit a permit
modification application if the permitted dry tons are expected to be over
permitted limits.
2. Per Permit Condition IV.3 residuals from each source generating facility shall be
analyzed at the frequency specified in Attachment A. As stated above, the reported
dry tons for Wade G. Brown WTP was 2,246 dry tons. Per the most recent
Attachment A, for facilities distributing >_ 1,650 short tons to < 16,500 short tons

per year, the required monitoring frequency is once per 60 days (6xyrs). The Wade
G. Brown WTP exceeded 1,650 dry tons in September 2023. Quarterly sampling
was completed for the Wade G. Brown WTP in 2023. Please provide an
explanation why required sampling was not completed after the month of
September 2023.
