Sullin, Director Division of Water Quality CERTIFIED MAIL: RETURN RECEIPT REQUESTED Cert. # 7007 0220 0003 1484 7425 Mr. Ross I Beebe 170 Hawks Pond Road New Bern, NC 28560 Subject Property Lot (Tax PIN) K06-76, DB 452,P 110, off Florence Road (SR1324) Moore Creek, Neuse River Basin REQUEST FOR ADDITIONAL INFORMATION Dear Mr. Beebe: DWQ Project # 07-1779 Pamlico County On October 17, 2007, the Division of Water Quality (DWQ) received your application dated October 12, 2007 to impact 0.02 acres of wetlands and 25 feet of streams to construct the proposed driveway stream crossing. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. On November 2, 2007, Roberto Scheller of this Office conducted an on-site review of the area for the proposed stream crossing. At the time of the visit the cannel was inundated with water from bank to bank as a result of wind tide. Fish were also noted forging in the subject channel at the time of the site visit. It has been determined by the Division of Marine Fisheries (DMF) that the subject channel is part of a Primary Nursery Area (PNA) and fill in this area is prohibited. Therefore, it will be necessary to bridge this feature from bank to bank. The DWQ requires this additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. It is requested that a new PCN be submitted showing total wetland impacts, buffer impacts and bridge impacts (if any). It is also requested that detailed plans for bridge construction also be submitted. Please respond in writing within three weeks of the date of this letter by sending this information to Mr. Roberto Scheller of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
