Also, the revised Declaration of Restrictions amendment language is appropriate. My remaining request is related to Conservation Area map consistency and compliance with Special Condition # 2 of the 9/12/2008 Nationwide Permit 12 verification: 1) The Declaration of Restrictions amendment language refers to areas shown as "Conservation Areas" on the Wetland Delineation Plat. However, the provided Wetland Delineation Plat does not label the subject areas as "Conservation Areas", which is required for clarity. I recommend changing the hatching for all of the subject areas to one type of shading and then adding a legend with the label "Conservation Areas" on each map sheet. 2) Special Condition # 2 of the 9/12/2008 Nationwide Permit 12 verification states: "The Permittee shall preserve and maintain all the jurisdictional waters and wetlands at the Triad Business Park as shown on the wetlands delineation map received by the Corps of Engineers on July 21, 2008, excluding the waters/wetlands at the Project Hermes (SAW -2008- 01894) site. Additionally, the permittee shall preserve and maintain a 30 foot buffer around all of the stream and pond features shown on the wetlands delineation map received by the Corps of Engineers on July 21, 2008. The jurisdictional areas, including the 30 foot buffer area, is referred to as the conservation area." The 30 foot buffer around all of the stream and pond features is not reflected on the submitted Wetland Delineation Plat. As such, please add these buffered areas to the map, conforming to #1 above as well. I recommend placing the buffered areas on the map using the same shading as the other conservation areas, and then overlaying the stream lines and pond boundaries for clarity. Also, the metes and bounds table must be updated to include the new conservation areas. Please send the updated information via email. Once these issues are resolved, and I receive the 401 permit, I can complete permit processing. Please let me know if you have any questions. -Dave Bailey David E. Pertaining to item one in the email I sent earlier today, please provide updated (accounting for culvert burial of 1') stream and wetland impact totals for BOTH Alternatives 1 and 3 to enable proper impact calculation comparison with your preferred alternative. Again, updated plan sheets for these alternatives are not necessary as long as changes in impact calculations from the original submission are explained.
