I have reviewed the additional information, dated January 7, 2016, provided by ClearWater Environmental Consultants in
support of the subject project. The applicants have satisfied all of my concerns regarding the project.
Please note that the applicants are still under Notice of Violation (NOV-2015-PC-0230) for stream and wetland violations
associated with a failing slope. A response to the NOV, dated September 28, 2015, was received by the Asheville Regional
Office, and approved in a letter dated October 9, 2015 (see attached). Recent correspondence indicated that the slope
stabilization plan would be submitted to this office by the end of January.

The Division of Water Resources (DWR) received correspondence from C1earWater
Environmental Consultants, Inc. dated September 28, 2015, in response to the NOV noted above.
The correspondence includes a plan for sediment removal, enhancement of the impacted wetland
by seeding in bare areas using a wetland seed mix, and a two year wetland monitoring plan. The
sediment removal and wetland seeding activities are proposed to be completed following
stabilization of the slope above the stream. The correspondence provides an anticipated schedule
of December 15, 2015, for submittal of the slope stabilization plan, and an anticipated
completion date of spring 2016 for the stabilization activities.
The sediment removal and wetland enhancement activities are approved. The DWR will review
the stabilization plan once it is received.
