NORTH CAROLINA Environmental Quality May 15, 2024 Subject: Application No. WQ0013263 Permit Application Return Town of Boone Class A Residuals Program Distribution of Class A Residuals Watauga County This letter is in response to the permit major modification and renewal request received on May 2, During the pre -review process, the Division noted that the following items were missing from the submitted application package: On May 2, 2024, the Division received the subject major modification and renewal application via the Non -Discharge online portal. The application requests an increase from 1,250 dry tons per year (DT/yr) to 1,500 DT/yr. This increase constitutes a major modification and requires an application fee pursuant to GS 143-215.3D.(d). Please submit the appropriate application fee in the amount of $348 made payable to the North Carolina Department of Environmental Quality to my attention at: 1617 Mail Service Center, Raleigh, NC 27699-1617. Accordingly, the Division is returning your permit major modification and renewal request as incomplete pursuant to 15A NCAC 02T .0107(b). The success of the Non -Discharge Branch's permitting process depends upon the receipt of complete and accurate applications and supporting documentation. Please amend the application package to include omitted items noted above and resubmit with the appropriate permit processing fee. When resubmitting, please submit the application electronically as a single PDF via the Non -Discharge online portal. Please be advised that construction and/or operation of the subject facilities without a valid permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions pursuant to G.S. 143-215.6A.9 6B., and 6C. The Division may assess civil penalties of up to $25,000 per day per violation for failure to secure a valid permit.
