On October 1, 2015, the Division of Water Resources (DWR) received a close-out packet with Monitoring
Reports from you on behalf of the Division of Mitigation Services (DMS) requesting approval to close-out
the subject site from monitoring. This site is described as a non-traditional Stormwater Wetland Best
Management Practice (BMP) and is located at the Higgins Greenway in Cary, North Carolina within the
Neuse 03020201. On October 16, 2015, Katie Merritt and Boyd Devane with DWR, Rick Riddle with
Division of Energy Mineral and Land Resources (DEMLR), and Eric Kulz with Town of Cary, visited the
subject site with you and Jeff Schaffer from DMS to assess the vegetation, condition and functions of the
BMP. It was noted onsite that the BMP was in compliance and there were no issues noted during the site
visit. Per Ms. Merritt's request, Mr. Kulz sent a copy of the Operation and Maintenance Agreement used by
the TOC for this site on October 19, 2015.
As a result of the DWR review of the close-out request and supporting materials, the following mitigation

According to the Memorandum of Agreement between NCEEP and the Town of Cary (TOC), the TOC is to
maintain the Stormwater Wetland BMP for a period of 30 years and must submit maintenance reports to
NCEEP upon the completion of the 30r' year.
Please note that NCEEP is required to maintain an accurate ledger for this project, and the ledger must be
available for review upon request.
