NOTICE OF WITHDRAWAL-EXPRESS REVIEW PROGRAM
On November 6, 2007, the Division of Water Quality (DWQ) received your PCN application for a
Stormwater Management Plan Approval to meet Condition 9 of the 401 Water Quality Certification
issued on October 22, 2007 concerning the above-referenced project. On November 9, 2007, and
November 21, 2007, the DWQ requested additional information. On November 30, 2007, the DWQ met
with the applicant and the project consultants to discuss the stormwater design and site constraints
because the site has contaminant issues and is considered a Brownfield site.
Per your request, see attached email correspondence submitted on December 3, 2007, we are withdrawing
your application from the Express Review Program. Should you choose to pursue the Waynesville
Commons Stormwater Management Project, you may reapply and resubmit through the regular
401/Wetlands Program with a new fee and a modified application, which clearly addresses the issues
DWQ identified in previous correspondence OR if you are still interested in having this project reviewed
through the Express Review Program, you may reapply with the submittal of an Initial Interest Form
[http://h2o.enr.state.nc.us/ncwetlands/express_review.htm], and apre-application meeting will be
required.
Please be aware that you have no authorization to install any of the stormwater BMPs proposed. in your
application without prior approval from this office, and that a stormwater management plan approval
issued by this office is required within 60 days of the date of issuance of your Certification before the
impacts specified in the Certification could occur.
